The duty to keep military records is assigned to each employer. But not all of them fulfill this duty. Your company is not one of them. And it is right! The work of a military registration specialist in any organization can be conditionally divided into three components: registration of newly recruited employees (having entered into an employment contract) on military registration; keeping up to date the keeping of military records at the established and necessary level; removal of an employee from military registration upon termination of labor relations. Answering your question, we will consider only the first, but the most difficult part of a specialist's work - the registration of an accepted employee on military registration.

Who is subject to military registration?

Three groups of workers are subject to military registration in organizations:

  • male citizens between the ages of 18 and 27, who are obliged to be on the military register and who are not in the reserve ("conscripts");
  • citizens in the reserve ("liable for military service");
  • citizens doing alternative civilian service.

Citizens of the latter category are put on military registration at the place of their stay, including in the organization of alternative civilian service, from December 12, 2011 in accordance with the amendments made to Federal Laws dated March 28, 1998 No. 53-F3 "On military duty and military service "( hereinafter - the Law on Military Obligation) and dated 25.07.2002 No. 113-F3 "On alternative civilian service".

When recruiting citizens of draft age, you need to know that not all of them are required to be on the military register. Some conscripts are exempt from military service (Clause 2, Article 22 of the Law on Military Obligation).

In most cases, conscripts are exempted from military duties for health reasons on the basis of a decision made by the draft board based on the results of a medical examination (IHC conclusion). In this case, they are issued a military ID, in which in clause 6 of section III the date, the name of the draft commission of the municipality and its decision are indicated - "Not fit for military service" indicating the category of the citizen's fitness for military service - "D".

The "liable for military service" includes:

Citizens doing alternative civilian service are put on military registration at the place of this service.

  • male citizens in the reserve;
  • dismissed from military service with enrollment in the reserve of the Armed Forces of the Russian Federation;
  • who successfully completed training under the program for training reserve officers at military departments at institutions of higher professional education and graduated from these institutions;
  • those who have not completed military service due to exemption from military service, granting deferrals from military service, or not called up for military service for any other reason after reaching the age of 27;
  • have completed alternative civilian service (Clause 12 of the Methodological Recommendations for maintaining military records in organizations approved by the General Staff of the RF Armed Forces; hereinafter - Methodological Recommendations).

Female workers are subject to military registration only if they have military registration specialties and professions, the list of which see on.

Citizens are not subject to military registration in organizations:

a) exempted from the performance of military duty in accordance with the Law on military duty;

b) undergoing military service;

c) those serving a sentence of imprisonment;

d) women who do not have a military specialty;

e) permanently residing outside the Russian Federation;

f) having military ranks of officers and being in the reserve of the SVR of Russia and the FSB of Russia.

The procedure for registering an employee for military registration when applying for a job can be divided into several stages.

The mark about the attitude to military duty is a rectangular stamp measuring 70x20 mm. By Decree of the Government of the Russian Federation of 22.03.2012 No. 228, the Ministry of Defense of the Russian Federation was instructed to determine the procedure for military registration of citizens (workers) at the place of their alternative civilian service. However, to date, this procedure has not been approved.

Stage 1 Verification of documents

Step 1 Obtaining military registration documents from the employee.

When concluding an employment contract, a citizen applying for work must present the employer with military registration documents only if he is liable for military service or subject to conscription ( Art. 65 of the Labor Code of the Russian Federation; hereinafter - the Labor Code of the Russian Federation).

Military registration documents are:

1. For conscripts - a certificate of a citizen subject to conscription for military service (certificate of registration);

2. For those liable for military service - a military ID (temporary certificate issued in exchange for a military ID).

Step 2 Checking military registration documents.

It is necessary to start by checking the presence in the passport of a citizen of the Russian Federation of a mark on the attitude to military duty ( US. 13 in the section "Conscription").

When verifying the authenticity of military registration documents and the authenticity of records in them, it is necessary to pay attention to the correspondence of these documents to the passport data of the citizen, to the presence of a photograph and its compliance with the owner, and in temporary certificates - for the duration of their validity. The forms of these documents, as well as the procedure for maintaining and storing them, are established in the Instructions for ensuring the functioning of the military registration system of citizens of the Russian Federation ( approved by order of the Minister of Defense of the Russian Federation of November 19, 2007 No. 500, hereinafter - Instructions on military registration).

At the same time, military registration documents must be kept (filled in) accurately, without corrections, blots and unspecified abbreviations, in a clear and legible handwriting. Records and signatures of officials are made only in black ink. The signatures of officials must be legible and include the following details: the name of the military position (position), military rank, the initial of the official’s name and surname.

1. Be sure to check in the military reserve for the presence in the military card of a mark on the delivery of a mobilization order to him. Stage 2 Filling in the employee's personal card

The military registration of conscripts and those liable for military service in organizations is carried out according to the personal cards of employees ( unified form No. T-2, approved. Resolution of the State Statistics Committee of Russia dated 05.01.2004 No. 1 "Approval of unified forms of primary accounting documentation for labor accounting and remuneration") and (or) personal cards of state (municipal) employees (unified form No. T-2 GS (MS)). In this case, the records should be made in ink, ballpoint, gel and other pens of black or blue colors, and the entries in clause 7 and the marks on the latest verification with the military registration documents of military commissariats (local government bodies) - in pencil.

  1. GENERAL PROVISIONS

II. MAIN OBJECTIVES

The main tasks of the military registration and booking inspector are:

documentary registration of military registration information about citizens registered in the military register;

Analysis of the quantitative composition and qualitative state of conscription mobilization human resources for effective use in the interests of ensuring the country's defense and state security;

S. FUNCTIONS

When carrying out primary military registration, local self-government bodies of settlements are obliged:

collect, store and process the information contained in the documents of the primary military registration in the manner prescribed by the legislation of the Russian Federation in the field of personal data and the Regulations on military registration. The composition of the information contained in the documents of the primary military registration, and the form of recording such information are determined by the Regulations on military registration;

keep the information contained in the documents of the primary military registration up to date and ensure that the information contained in the documents of the military registration is kept up to date. At the same time, information on changes in the information contained in the military registration documents should be sent to the military commissariat for the Krasnogorsk and Yukamensk regions of the UR within two weeks from the date of its receipt;

send, within two weeks, at the request of the military commissariat for the Krasnogorsk and Yukamensk districts of the UR, the information necessary for entering the military registration documents on citizens entering the military registration, being in the military register, as well as not being, but obliged to be in the military register;

IV. RIGHTS

When carrying out primary military registration, local self-government bodies of settlements have the right:

request from organizations and citizens the information necessary for entering into military registration documents;

summon citizens on military registration issues and notify citizens about calls (summons) of the military commissariat for the Krasnogorsk and Yukamensk regions of the UR;

determine the procedure for notifying citizens about calls (summons) of the military commissariat for the Krasnogorsk and Yukamensk regions of the UR;

V. GUIDANCE

5.1. An inspector for military registration and reservation is appointed and dismissed by the head of the local self-government body.

3.1 In order to organize and ensure the collection, storage and processing of information contained in the documents of the primary military registration, the military registration and reservation inspector is obliged to:

3.1.1 carry out primary military registration of citizens in reserve and citizens subject to conscription, residing or staying (for a period of more than 3 months);

3.1.2 identify, together with the internal affairs bodies, citizens living or staying (for a period of more than 3 months) and subject to military registration;

3.1.3 keep records of organizations located on the territory and control the maintenance of military records in them;

3.1.4 collect, store and process the information contained in the documents of the primary military registration, in the manner prescribed by the legislation of the Russian Federation in the field of personal data and the Regulations on military registration. The composition of the information contained in the documents of the primary military registration, and the form of recording such information are determined by the military commissariat for the Krasnogorsk and Yukamensky districts of the UR.

3.2 In order to keep up to date the information contained in the documents of the primary military registration, and to ensure that the information contained in the military registration documents is kept up to date, the military registration and booking inspector is obliged to:

3.2.1 check, at least once a year, the documents of the primary military registration with the documents of the military registration of the military commissariat for the Krasnogorsk and Yukamensky districts of the UR and organizations, as well as with registration cards or house books;

3.2.3. send, within two weeks, at the request of the military commissariat for the Krasnogorsk and Yukamensk districts of the UR, the information necessary for entering the military registration documents on citizens entering the military registration, being in the military register, as well as not being, but obliged to be in the military register;

3.2.4 explain to officials of organizations and citizens their obligations for military registration, mobilization training and mobilization, established by the legislation of the Russian Federation, to monitor their implementation, as well as inform about responsibility for failure to fulfill these obligations;

3.2.4 submit to the military commissariat for the Krasnogorsk and Yukamensk districts of the UR information on cases of non-fulfillment by officials of organizations and citizens of their duties for military registration, mobilization training and mobilization.

3.3. In order to organize and ensure the registration of citizens on military registration, the military registration and reservation inspector is obliged to:

3.3.1 check the availability and authenticity of military cards (temporary certificates issued instead of military cards) or identity cards of citizens subject to conscription, as well as the authenticity of the entries in them, the presence of mobilization orders (for the reserve conscripts, if there are marks in the military cards about them) delivery), marks in military registration documents on the removal of citizens from military registration at their former place of residence, marks in the passports of citizens of the Russian Federation about their attitude to military duty, tokens with personal numbers of the Armed Forces of the Russian Federation (for military service reserve if there are marks in military cards on their delivery);

3.3.2 fill out the primary registration cards for reserve officers. Fill in (in 2 copies) alphabet cards and registration cards for ensigns, warrant officers, foremen, sergeants, soldiers and sailors in the reserve. Fill in the registration cards of conscripts. The filling out of these documents is carried out in accordance with the entries in military cards (temporary certificates issued in exchange for military cards) and certificates of conscripts. At the same time, clarify information about marital status, education, place of work, position, place of residence or place of temporary stay of citizens and other necessary information contained in the documents of citizens accepted for military registration;

3.3.3 submit military cards (temporary certificates issued in exchange for military cards), alphabetical and registration cards of warrant officers, warrant officers, foremen, sergeants, soldiers and sailors of the reserve, certificates of citizens subject to military service, registration cards, as well as passports of citizens of the Russian Federation Federation with missing marks on the attitude of citizens to military service within 2 weeks to the military commissariat for the Krasnogorsk and Yukamensk regions of the UR for registration of military registration. Notify conscripts about the need to personally appear at the military commissariat for the Krasnogorsk and Yukamensk regions of the UR for military registration. 3.3.4 make notes on the military registration of citizens in registration cards or house books.

3.4 In order to organize and ensure the removal of citizens from military registration, the military registration and reservation inspector is obliged:

3.4.1 submit military registration documents and passports to the military commissariat for the Krasnogorsk and Yukamensk districts of the UR in the absence of marks on the attitude of citizens to military service for the appropriate execution of these documents. Notify reserve officers and conscripts about the need to personally appear at the military commissariat for the Krasnogorsk and Yukamensk districts of the UR for removal from military registration. If it is necessary to clarify the military credentials of those liable for military service, notify them of the need to personally appear at the military commissariat for the Krasnogorsk and Yukamensk regions of the UR. When accepting military registration documents and passports from citizens, issue receipts;

3.4.2 to make in the documents of the primary military registration, as well as in the registration cards or in the house books, the corresponding notes on the removal from the military register;

3.4.3 draw up and submit to the military commissariat for the Krasnogorsk and Yukamensk districts of the UR within 2 weeks the lists of citizens who have left for a new place of residence outside the municipality without being removed from the military register;

3.4.4 store the documents of the primary military registration of citizens removed from the military register until the next reconciliation with the registration data of the military commissariat for the Krasnogorsk and Yukamensky districts of the UR, and then destroy them in the prescribed manner.

3.5 collect information on the passage of medical examinations by citizens during the initial military registration, conscription or enrollment in military service under a contract, admission to military educational institutions of vocational education, conscription for military training, medical re-examination previously recognized as partially fit for military service for health reasons;

Absolutely all employers have such a duty as the organization of military registration, and its purpose is to meet the needs of the state and help manage the available resources during hostilities (in wartime). But the first step is to study the documents that regulate the procedure for maintaining military records in the organization in 2020.

Currently, military registration in the organization is carried out on the basis of the following legal acts:

  • Federal Law of 31.05.1996 No. 61-FZ "On Defense";
  • Federal Law of 26.02.1997 No. 31-FZ "On mobilization preparation and mobilization in the Russian Federation";

Officials regularly update the regulatory framework, adding new responsibilities to employers. So, from October 19, 2019, the Government Decree of October 9, 2019 No. 1302, amended, came into effect. The amendments stipulate that employers are obliged to use certificates issued in exchange for military cards in their work. The organizations had such a duty before, but there was no mention of the certificate itself in the Regulations on military registration. In addition, employers were obliged to check the personal electronic cards of military personnel from citizens entering work, if the data on their issuance is indicated in the accounting documents.

Another change concerns the obligation to use personal cards in the form No. T-2 in work with military-liable employees. Henceforth, for these purposes, you should use accounting documents that will be approved by the Russian Ministry of Defense. There are no corresponding forms yet, but they will appear.

Military accounting work (VUR) is conditionally subdivided into the following categories:

  1. General military registration.
  2. Special military registration - booking of citizens liable for military service in reserve (GPZ).

Organization of military registration in the organization. Step-by-step instruction

Step 1. Appointment of the person responsible for accounting

The maintenance of military records in an organization must begin with the issuance of an order and the appointment of a responsible person and persons who will carry out records during the absence of the main responsible. Most of this work is done by employees of the HR department, and in small companies - by a manager or even an accountant.

Example order

On the basis of the Government Decree of November 27, 2006 No. 719, those responsible for accounting are appointed based on the following standards:

  • 1 employee performing part-time duties - if there are less than 500 citizens on the military register;
  • 1 exempt worker - if 500-2000 citizens are registered;
  • 2 released workers (military registration desk) - if there are from 2000 to 4000 citizens on the military register;
  • 1 exempt worker for every 3,000 registered citizens.

A copy of the order on those responsible for registering those liable for military service must be submitted to the local military commissariat (VK). Subsequent changes must be notified to VK.

Step 2. Determine who to work with

All citizens of the Russian Federation are required to be on the military register (clause 1 of article 8 of the Federal Law of 28.03.1998 No. 53-FZ). Exceptions are persons:

  • undergoing military service;
  • serving a sentence of imprisonment;
  • women who do not have a military specialty;
  • permanently residing outside the Russian Federation.

In accordance with Government Decree No. 719, Methodological Recommendations for maintaining military records at enterprises, approved by the General Staff of the Armed Forces of the Russian Federation on July 11, 2018, it is necessary to take into account:

  • men of military age (18-27 years old), not enrolled in the reserve;
  • males in stock;
  • employees trained at military departments in vocational education institutions;

If the military registration at the enterprise has not been kept before, or the company was created recently, first you need to make an appointment at the local military commissariat. Document flow for military accounting

The company where the accounting is carried out provides in VK:

  • information about hired or dismissed citizens who are or are obliged to be on the military register (within two weeks);
  • lists of men who will turn 17 next year (every year - until November 1), and every September - lists of young people 15 and 16 years old.

The main documents of military registration, on the basis of which section II of the personal card of form No. T-2 is filled out, are:

The employing company is obliged to create and maintain the following accounting documents:

  • an order on the organization of military registration and booking of citizens who are in reserve;
  • a work plan for maintaining military records and booking citizens in reserve;
  • a card index of personal cards of forms No. T-2 and No. T-2 GS for citizens who are in reserve and citizens who are subject to conscription. Form T-2 for these purposes is planned to be canceled soon or transferred to electronic format, follow the amendments to the legislation;
  • a log of checks of the state of military registration and reservations of citizens who are in reserve;
  • receipts for the acceptance of military registration documents and stubs from them;
  • registration card of the organization (KUO form No. 18);
  • other documents in accordance with the requirements established by federal executive bodies, executive bodies of the constituent entities of the Russian Federation, local self-government bodies and heads of enterprises.

In addition, the employer is obliged to conduct explanatory work with employees subject to registration. In accordance with paragraph 27 of the Methodological Recommendations, employees should be provided, among other things, with background information on mobilization and preparation for it.

Modern software products make it possible to automate part of the VUR, generate and print various documents for military registration.

Practical part

When applying for a job, in accordance with article 65 of the Labor Code, the applicant is obliged to present a military ID, temporary certificate or certificate in exchange for it. In practice, candidates sometimes evade this obligation, referring to the fact that the military ID is in the military registration and enlistment office, is lost, there are no forms, etc. In this case, the employer has the right to refuse to conclude an employment contract with the applicant, at least until all documents are submitted. ... The employer can meet halfway and take a written receipt from the future employee, which indicates the deadline for submitting the document.

Another option is to independently apply to the military registration and enlistment office at the place of registration of the employee with a request for his status or with information about the absence of proper documents and marks from an already accepted employee.

In any case, the absence of a military ID must be recorded in writing in order to secure the company from administrative liability for violating the requirements of the law on the registration of persons liable for military service.

When concluding an employment contract, the employer is obliged to check the presence of a registration mark at the military registration and enlistment office at the place of residence in the passport, a valid military ID or a certificate of registration. Nonresident workers are required to appear at the military registration and enlistment office within 2 weeks from the date of receipt of temporary registration. If the temporary registration is for more than three months, then attendance at the military registration and enlistment office is required.

From 19.10.2019, the presence and authenticity of personal electronic cards is subject to mandatory control, if the documents indicate that they were issued.

The person in charge makes a copy or scans the military ID (replacing it) in full or from all pages on which there are records.

Reservation of citizens staying in reserve (GPZ)

Step-by-step instructions for maintaining military records in organizations include such a separate area as booking citizens who are in reserve. Its goal is to provide personnel, labor resources during the period of mobilization and in wartime. Reservation consists in providing citizens who are in the reserve (managers, specialists, highly qualified personnel) with a deferral from being called up for military service in wartime.

Reserved citizens who are in reserve are subject to counting, but they are exempt from conscription for military service for mobilization and subsequent conscriptions in wartime for the duration of the granted deferral, and from conscription for military training.

Regulatory and methodological support and control over this is carried out by the Interdepartmental Commission of the Armed Forces of the Russian Federation, federal executive bodies that have a reserve and work in government bodies, local government bodies and private companies.

To book citizens who are in reserve, the employer is sent approved lists of positions and professions (extracts from the lists) and extracts from regulatory documents.

The relevant decisions are made at meetings of the mobilization commission in the department of special events (in the administration of the municipality) with the direct participation of a representative of the VK department. Subsequently, this decision is communicated to the enterprise by handing it over to the authorized person of the employer against signature.

Forms of form No. 4 (certificates of deferral) by power of attorney from the enterprise are issued at the local VK. Employees are booked according to a special list, it specifies the requirements for the GPP - profession, age, rank. Employer reporting

Companies provide accounting reports:

  • to federal government bodies or to the head office;
  • to the city commission for the reservation of citizens staying in reserve;

Control over the implementation of legislation

Inspection in large companies (more than 500 employees) is carried out once a year. Inspection in small enterprises (less than 500 people) is carried out once every 3 years. The regularity of inspections largely depends on the activity of the local VC, therefore it is safer to fill in all the necessary accounting documents in a timely manner and carry out planned activities.

Checks are carried out by representatives of the military registration and enlistment office or local government bodies. They must assess the military registration work of a legal entity for compliance with the requirements of Russian legislation. In addition, they control the accuracy and completeness of the documents provided (after gaining access to personal cards of employees, work plans).
