In practice, the question often arises: should the sole executive body and the actual head of a medical organization have a medical education and professionally understand the main activities of the clinic, or whether it is enough for him to be a capable administrator and understand non-core areas. Let's turn to the legislation and the practice of its application.

The Labor Code of the Russian Federation and the Federal Law “On the Fundamentals of Health Protection of Citizens in the Russian Federation” No. 323-FZ does not contain special qualification requirements for the position of “head of a medical organization”.

These requirements are contained in by-laws governing the qualification characteristics of positions, such as:

    Nomenclature of positions of medical workers and pharmaceutical workers, approved by Order of the Ministry of Health of the Russian Federation No. 1183n dated 20.12.2012;

    Unified qualification reference book of positions of managers, specialists and employees, section "Qualification characteristics of positions of workers in the field of health care", approved. Order No. 541n dated July 23, 2010

The list of positions that make up the "Positions of managers" is disclosed in the Nomenclature of positions of medical workers and pharmaceutical workers, approved. By order of the Ministry of Health of the Russian Federation No. 1183n dated 20.12.2012. According to this document, "Positions of managers" are included in clause 1.1 of section I "Medical workers."

So, section I "Medical workers", subsection 1.1. "Positions of managers":

    chief physician (head) of a medical organization;

    director of a hospital (home) nursing, hospice;

    deputy head (head) of a medical organization;

    the head (head) of a structural unit (department, department, laboratory, office, detachment, etc.) of a medical organization - a specialist doctor;

    head (chief physician, head) of a structural unit carrying out medical activities of another organization;

    chief nurse (chief midwife, chief paramedic).

In the note to the nomenclature of posts, an important disclaimer is made in relation to 3 of the 6 posts listed above, namely, in relation to:

    "Chief physician (head) of a medical organization",

    "Deputy head (head) of a medical organization",

    "The head (chief physician, head) of a structural unit carrying out medical activities of another organization."

A note to the document says that the above 3 positions refer to the positions of medical workers in the event that their labor (official) duties include the implementation of medical activities.

There is no such reservation with regard to the remaining 3 positions, including the position of “director of a hospital (home) nursing care, hospice”.

Unified qualification reference book of positions of managers, specialists and employees, approved by Order No. 541n of 23.07.2010 in section II "Positions of managers" does not indicate the mandatory presence of medical education in relation to the position:

    Head (chief physician, director, head) of federal budgetary institutions of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare,

    Hospital (home) nursing and hospice directors.

An employee in the position of "chief physician (president, director, head, manager, head of a medical organization)" may or may not have a medical education, but in any case must have a certificate of a specialist in the specialty "Organization of health care and public health" and work experience in managerial positions.

With regard to the position of "chief physician (president, director, head, manager, head of a medical organization)", the following qualification requirements are imposed:

"Higher professional education in the specialty" General Medicine "," Pediatrics "," Preventive medicine "," Dentistry ", postgraduate professional education and / or additional professional education, a certificate of a specialist in the specialty" Organization of health care and public health "or higher professional (economic, legal) education and special training in health care management, work experience in managerial positions for at least 5 years. For the president of a medical organization, work experience in medical organizations is at least 25 years.

With regard to the position of “director of a hospital (home) of nursing care, hospice,” the following qualification requirements are imposed:

In the Letter of the Ministry of Labor and Social Protection of the Russian Federation No. 14-0 / 10 / B-2253 dated April 4, 2016, with reference to the Labor Code of the Russian Federation, two cases are named, in the presence of which the requirements of professional standards are mandatory:

    if, in accordance with the Labor Code of the Russian Federation or other federal laws, the provision of compensation and benefits or the presence of restrictions is associated with the performance of work in these positions, professions, specialties (Article 57 of the Labor Code of the Russian Federation);

    if the requirements for the qualifications necessary for the employee to perform the labor function are established by the Labor Code of the Russian Federation, other federal laws, other regulatory legal acts of the Russian Federation (Article 195.3 of the Labor Code of the Russian Federation).

The legislation on the licensing of medical activities establishes the requirements for the level of education of the head of a medical organization (subparagraph c, item 4 of the Regulation on the licensing of medical activities, approved by Decree of the Government of the Russian Federation No. 291 of 04.16.2012).

So, the head of a medical organization, deputy heads of a medical organization responsible for carrying out medical activities should have:

    higher medical education;

    postgraduate and (or) additional professional education, provided for by the qualification requirements for specialists with higher and postgraduate medical education in the field of health care;

    specialist certificate;

    as well as additional professional education and a certificate of a specialist in the specialty "organization of health care and public health";

    work experience in the specialty for at least 5 years.

Compliance with these requirements must be documented.

The phrase "responsible for the implementation of medical activities" draws attention and gives rise to conflicts in practice.

As can be seen from the above normative acts, there is a conflict between the Unified Qualification Handbook, the Nomenclature of Positions in the Healthcare Sector and the Regulations on the Licensing of Medical Activities. In this regard, the assessment of this conflict by the courts is of interest.

Law enforcement practice of arbitration courts.

The law enforcement practice of arbitration courts that we have discovered indicates that the supervisory authorities, as a rule, always assess the absence of a head of medical education as a violation of licensing requirements. A fine is applied to the violator in accordance with part 4 of article 14.1 of the Administrative Code of the Russian Federation.

Arbitration courts, considering the issue of the validity of the application of penalties, in most cases, confirm the correctness of the conclusions of the regulatory authorities, and less often take the side of a medical organization.

A qualifying feature in the application of the said rule of law is the fact that the relevant official (head, deputy heads, head of a structural unit) is responsible for carrying out medical activities.

At the same time, from the documents presented by the Company it follows that Gritsay O.The. is not responsible for the implementation of medical activities, the Company has two managers: the director and the head of the medical service, by order of 01/09/2013 N 3-1 the job responsibilities that are within the competence of the head of the medical service and the director are distributed. 1. 2. The qualification characteristics contained in the TSA section (hereinafter referred to as qualification characteristics) are used as regulatory documents, and also serve as the basis for the development of job descriptions containing a specific list of job duties, taking into account the peculiarities of the work of workers in medical organizations. The job titles of specialists with higher medical and pharmaceutical education are established in accordance with the Qualification Requirements for specialists with higher and postgraduate medical and pharmaceutical education in the field of healthcare, approved in accordance with the established procedure by the Ministry of Health and Social Development of Russia. For example, the job title corresponds to a medical specialty.

The names of the positions of specialist doctors and specialist pharmacists are established in accordance with the names of medical and pharmacist specialties, the nomenclature of which is approved in the prescribed manner.

The name of the position is retained for specialists with higher professional (non-medical) education, hired for this position before October 1, 1999.

In the case of a doctor. a specialist (pharmacist) has a break in his specialty for more than 5 years or changes the profile of a specialty that requires special training and qualifications, he is appointed to the position of a doctor. trainee (pharmacist, trainee) for the period of professional retraining in accordance with the established procedure in order to obtain special knowledge, skills and abilities necessary for independent work as a specialist doctor (pharmacist), and obtain a certificate in the relevant specialty.

3. The titles of the positions of the deputy heads of a medical organization (chief physician, director, head, chief) shall be supplemented by the name of the section of the work that he manages. For example, "deputy chief physician for medical affairs", "deputy chief physician for work with nursing personnel", etc.

The names of the positions of the heads of structural divisions (departments, divisions, laboratories, offices, detachments, etc.) are supplemented by the name of a medical position corresponding to the specialty in the profile of the structural division. For example, "the head of the surgical department is a surgeon."

4. The qualification characteristics of each position contains three sections: "Job responsibilities", "Must know" and "Qualification requirements".

In the section "Job responsibilities" there is a list of the main functions that can be assigned to an employee holding this position, taking into account the technological homogeneity and interconnectedness of work, received professional education.

The section "Should know" contains the basic requirements for an employee in relation to special knowledge, as well as knowledge of legislative and other regulatory legal acts, regulations, instructions and other documents, methods and means that the employee must be able to use in the performance of job duties.

The section "Requirements for qualifications" defines the levels of the required professional education of the employee, necessary to perform the assigned job duties, as well as the required length of service. The levels of required professional training specified in the section "Requirements for qualifications" are given in accordance with # M12291 9003751 Law of the Russian Federation "On Education" dated July 10, 1992 N 3266-1 # S (Collected Legislation of the Russian Federation, 1996, N 3, Art. .150) and other regulatory legal acts.

5. The official title "senior" is established on condition that the specialist is in charge of subordinate performers.

6. Persons who do not have the appropriate additional professional education or work experience established by the qualification requirements, but who have sufficient practical experience and perform the job duties assigned to them with high quality and in full, on the recommendation of the certification commission of the medical organization, as an exception, may be appointed to relevant positions as well as persons with special training and the necessary work experience.

The employer shall take measures for the further professional training of the said persons.

7. In medical organizations, job titles: "midwife", "nurse", "nurse", "packer", replaced by males, are named accordingly: "midwife", "medical brother (nurse)", "orderly", " packer ".

The title of the position "Chief Physician" can be used only if the head of a medical organization has a higher professional (medical) education.
