In the operative part, it is necessary to record the list of positions for which the instruction is approved. It should also include the dates the directors approved the instructions. In this case, the date of signing the order must coincide with the date of approval of the instructions (or precede it).

2. 3. Job regulations (job descriptions) are developed individually for each employee filling a position in the bodies, organizations, subdivisions of the system of the Ministry of Internal Affairs of Russia, by immediate supervisors (chiefs) of employees.

4. Immediate managers (chiefs) can be developed and approved, taking into account the provisions contained in paragraphs 5-10 of the Procedure, job regulations (job descriptions) for positions of the same name. Job regulations (job descriptions) for positions of the same name are used to familiarize employees when they are appointed to positions of the same name, as well as to develop individual job regulations (job descriptions).

5. The development of job regulations (job descriptions) is carried out in accordance with the Federal Law of November 30, 2011 N 342-FZ "On service in the internal affairs bodies of the Russian Federation and amendments to certain legislative acts of the Russian Federation", other legislative acts of the Russian Federation, acts of the President of the Russian Federation and the Government of the Russian Federation in the field of internal affairs, regulatory legal acts of the Ministry of Internal Affairs of Russia, taking into account the powers of bodies, organizations, subdivisions of the system of the Ministry of Internal Affairs of Russia, and their structural divisions. Job regulations (job descriptions) of employees who have been assigned special police ranks are developed taking into account the Federal Law of February 7, 2011 N 3-FZ "On the Police".

11.2. 12. The job description (job description) is drawn up in two copies, with each of which the employee must be familiarized with a receipt by the immediate supervisor (chief). Development of a draft order on the approval of the job description

The presence of job descriptions in the organization is optional, but recommended. And if the company decides to use them, they are developed for each unit in the state.

The instruction is put into effect after its approval by the head of the company. According to GOST R 6.30-2003 “Unified documentation systems. Unified system of organizational and administrative documentation. Requirements for paperwork ", enacted by the decree of the Gosstandart of the Russian Federation of March 3, 2003 No. 65-st, documents can be approved in 2 ways:

The use of the second method has an advantage when several job descriptions are approved at once. Then one order lists all the positions for which instructions are put into effect.

The procedure for approving job descriptions can be fixed in the company local act, but this is optional.

Usually, a new job description is approved according to the following algorithm:

  • a draft of a specific instruction is being developed;
  • an order is issued to approve the job description;
  • the order together with the instruction is agreed by the legal department (lawyer) and is given to the head of the company for signature;
  • the order is registered in the registration book (journal), and a certain number is assigned to it; the job description itself can also be recorded in a separate journal, if one is established.

The job description becomes mandatory for the employee after familiarizing him with the document on receipt.

What details should be in the order?

GOST R 6.30-2003 discloses the issue of the mandatory inclusion of certain details in such a document form as an order. Must be present here:

  • name of company;
  • title of the document (ORDER);
  • date and registration number;
  • the text of the document;
  • place for signature official approving the order, indicating the position;
  • mark about the artist;
  • place for visa approval, if necessary.

After reviewing the document, the employee's signature is affixed on a special sheet, which is part of the job description.

Order on the approval of job description approved by the head of the company, and only after that it can be used. To make changes to the document, they will also have to be approved. And with the introduction of a new instruction, the old one loses its force.

Drawing up an order on the approval of job descriptions is the final stage in the procedure for the development and consolidation of documents defining the functions, rights, powers and working conditions of employees of enterprises and organizations.

Why are job descriptions and an order for their approval needed?

Role job descriptions is quite understandable and simple: they clearly describe the tasks that the employees of the companies who are in a particular position are obliged to perform, as well as the working conditions accompanying their activities.

At the same time, job descriptions are not strictly necessary documents, however, they have the widest distribution and concern representatives of any profession. Their presence allows you to protect the employer from unfounded claims from subordinates, and employees, in turn, from excessive workload and the performance of those functions that are not included in their direct responsibilities.

Job descriptions are developed on an individual basis in accordance with and approved by the order of the management - without this document they do not enter into force.

Moreover, all job descriptions may change periodically in terms of the information they contain, depending on the needs and the current situation at the enterprise, but the corrected documents also need to be approved by the order of the head.

It should be noted that the information entered into these documents must strictly comply with the framework of the legislation of the Russian Federation and in no way violate civil and labor rights workers.

That is why the preparation of job descriptions is usually within the competence of the heads of structural divisions, and then transferred for review and approval to the company's in-house legal adviser or a third-party lawyer - this measure excludes the presence of gross errors and conditions that violate the rights of employees.

Is it possible to replace the order with another form of approval

The order, as well as the job description itself, is not a mandatory document, therefore, sometimes instead of writing a separate administrative paper, it is enough just to put the head's resolution on the job description.

However, if the enterprise is large with whole line structural divisions, employees and, accordingly, many positions fixed in the staffing table, it is much easier and more convenient for the director to put job descriptions into effect with one order than to endorse dozens of separate documents.

Basis for order

Any order must be justified by something, and this is no exception. Usually, a reference to a very specific law is given as a basis, but in this case, there is no direct requirement in the legislation to write and approve job descriptions.

So in the text of the order, it is enough just to write something like: "In connection with the need to observe labor discipline and work organization, I order" ...

Who writes the order directly

The order on the approval of job descriptions can be drawn up by any employee of the organization who is entrusted with this function:

  • legal adviser,
  • HR specialist,
  • secretary, etc.

The main condition is for a person to have a clear idea of ​​how to correctly draw up and execute this document.

After writing the order, it must be handed over to the director of the company for signature, since without his autograph the order will not be considered valid and subsequently it can be easily challenged in court.

How to draw up an order

Today there are no standards for drawing up orders approving job descriptions. So enterprises and organizations can write this document in any form or use a sample approved in the accounting policy of the company. However, it is still necessary to indicate some information in it:

  • room,
  • date and place of compilation,
  • Company name,
  • a complete list of job descriptions approved by the order.

The document should indicate the persons responsible for its implementation (this part concerns familiarization with the job descriptions of employees of the enterprise), and the job descriptions themselves, if necessary, can be marked as a separate item as an attachment to the order. In addition, the order can be supplemented with any other necessary information.

How to issue an order

There are no uniform standards for the execution of an order, as well as for its content: it can be written on a simple blank sheet of A4 or even A5 format, both by hand and printed on a computer.

An important condition: the order must contain the original signature of the director or other employee authorized to endorse the company's administrative documents.

Also, employees responsible for its execution should be familiarized with it against signature.

How to store an order

An order is usually created in a single copy and then recorded in the accounting journal internal documents organizations. During the validity period, the order must be kept together with all other administrative documents of the company in a place to which access should be limited. After losing its relevance, it is transferred to the archive of the enterprise, where it is stored for the period established by legislation or local regulations of the company (but not less than three years), after which it can be disposed of.

Order on the approval of job descriptions

For the introduction of a new job description, the director publishes job description order.

Local assertion normative act is under the authority of the head of the human resources department or other responsible person. WITH new instruction meets a specialist who will work on this position. This rule is enshrined in the collective agreement, regulated by Labor Code RF.
