Unified Federal Register of Tour Operators

The Federal Tourism Agency informs that, in accordance with Art. 4.1. Federal Law No. 132-FZ of November 24, 1996 "On the Basics tourist activities v Russian Federation"(Hereinafter referred to as the Law on Tourism Activities), tour operator activities on the territory of the Russian Federation are allowed legal entity subject to the following conditions:

Availability of financial security for the liability of the tour operator (an agreement or contracts of insurance of civil liability for failure to fulfill obligations under an agreement on the sale of a tourist product and (or) a bank guarantee or bank guarantees for the fulfillment of obligations under an agreement on the sale of a tourist product);

Compliance of persons holding the positions of the head of the tour operator, his deputy, chief accountant, other official entrusted with the conduct accounting the tour operator, the requirements established by part three of Article 4.1 of the Law on Tourism Activities;

Tour operator membership in the association of tour operators in the field of outbound tourism ;

Availability of the personal responsibility fund of the tour operator (in the case of activities in the field of outbound tourism);

Availability of information about the tour operator in the unified federal register of tour operators.

The requirements for the financial security of the liability of the tour operator are determined by Chapter VII.I of the Law on Tourism Activities.

Financial security the tour operator's responsibility is not required for:

an organization providing excursion services on the territory of the Russian Federation for no more than 24 hours in a row;

state and municipal unitary enterprises, as well as state and municipal institutions carrying out travel arrangements within the territory of the Russian Federation in order to solve social problems;

a tour operator operating in the field of outbound tourism and having a personal liability fund of the tour operator formed in accordance with Article 11.6 of the Law on Tourism Activities in the amount of at least seven percent of the total price of a tourism product in the field of outbound tourism for the previous year.

Please note that the implementation of tour operator activities by a person, information about which is not available in the unified federal register of tour operators, entails the imposition of an administrative fine on officials in the amount of fifty thousand to one hundred thousand rubles or disqualification for a period from six months to one year; for legal entities - from five million to ten million rubles.

The Government of the Russian Federation decides:

6. Allow the Federal Agency for Tourism, within the established number of employees and the wage fund, to include central office up to 5 departments for the main directions of the Agency's activities.

7. To the Ministry of Finance of the Russian Federation on the proposal of the Federal Agency for Tourism and the Federal Agency for physical culture and sports to ensure the transfer, in accordance with the established procedure, to the Federal Agency for Tourism of funds envisaged for 2005 to support tourism activities, implementation of activities in the field of tourism, payment of contributions to international organizations, as well as for applied research and development.

I. General Provisions

1. The Federal Agency for Tourism (Rosturizm) is a federal executive body that carries out the functions of providing state services, managing state property, as well as law enforcement functions in the field of tourism and tourism activities.

3. The Federal Agency for Tourism is guided in its activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties Of the Russian Federation, regulatory legal acts of the Ministry of Economic Development of the Russian Federation, as well as these Regulations.

4. The Federal Agency for Tourism carries out its activities in cooperation with other federal executive bodies, executive bodies of the constituent entities of the Russian Federation, bodies local government, public associations and other organizations.

II. Credentials

5. The Federal Agency for Tourism exercises the following powers in the established area of activity:

5.2.1. establishes the procedure for the submission by tour operators in respect of which the legislation of the Russian Federation does not provide for the mandatory publication of accounting (financial) statements at the end of the reporting year, copies of the annual accounting (financial) statements at the end of the reporting year to the Agency;

5.2.2. establishes and informs tour operators operating in the field of outbound tourism, the conditions and formats for the presentation by a tour operator operating in the field of outbound tourism, reporting (except for accounting (financial) statements), including in the form electronic documents, as well as the control ratios of its indicators;

5.3. on the basis and in accordance with the procedure established by federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, the Federal Agency for Tourism carries out the following functions for the management of state property and the provision of public services in the established field of activity:

5.3.1. implements priority directions state regulation tourist activity in the Russian Federation, carries out the formation and maintenance of a unified federal register of tour operators;

5.3.1.1. implements documents strategic planning in the field of tourism on issues attributed to the jurisdiction of the Russian Federation in terms of the scope of the Agency;

5.3.1.2. carries out Information Support tourism, including assistance in the creation and operation of tourist information centers, navigation and orientation systems in the field of tourism;

5.3.1.3. creates and provides favorable conditions for development tourism industry In Russian federation;

5.3.1.4. assists in organizing vocational training on training programs for specialists in the field of tourism in accordance with the legislation of the Russian Federation;

5.3.1.6. implements calendar plan all-Russian and interregional events aimed at supporting priority areas of tourism development, including the development of domestic tourism, inbound tourism, social tourism, children's tourism and amateur tourism;

5.3.1.7. assists in the creation and provision of favorable conditions for the unhindered access of tourists (excursionists) to tourist resources located in the territories of the constituent entities of the Russian Federation, and communication facilities, as well as in obtaining medical, legal and other types of emergency assistance;

5.3.2. informs in the prescribed manner tour operators, travel agents and tourists about the threat to the safety of tourists in the country (place) of temporary stay;

5.3.3. organizes and conducts events to promote tourism products in the field of domestic tourism and inbound tourism in the domestic and world tourist markets;

5.3.4. carries out in accordance with the legislation of the Russian Federation and other regulatory legal acts on contract system in the field of procurement of goods, works, services to meet state and municipal needs; procurement of goods, works, services in the established field of activity;

5.3.5. exercises in the manner and within the limits determined by federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, the powers of the owner in relation to federal property necessary to ensure the performance of the functions of the federal government body in the scope of activities established by paragraph 1 of this Regulation, including property transferred federal government agencies and federal state unitary enterprises subordinate to the Agency;

5.3.6. carries out economic analysis activities of subordinate state unitary enterprises and approves economic indicators their activities, conducts inspections of financial and economic activities and the use of the property complex in subordinate organizations;

5.3.7. carries out the functions of the state customer of federal target, scientific, technical and innovative programs and projects in the established field of activity;

5.3.8. interacts in accordance with the established procedure with public authorities of foreign states and international organizations, including representation on behalf of the Government of the Russian Federation, the Ministry of Economic Development of the Russian Federation of the interests of the Russian Federation in international organizations in the established field of activity;

5.3.9. creates representative offices outside the Russian Federation in the field of tourism. The procedure for their creation, operation and liquidation is determined by the Government of the Russian Federation in accordance with international treaties of the Russian Federation;

5.3.10. organizes the reception of citizens, ensures the timely and full consideration of oral and written applications of citizens, the adoption of decisions on them and the direction of responses to the applicants within the period established by the legislation of the Russian Federation;

5.3.12. organizes and ensures the mobilization preparation and mobilization of the Agency, as well as control and coordination of the activities of the organizations under its jurisdiction for their mobilization training and mobilization;

5.3.12.1. organizes and maintains civil defense at the Agency;

5.3.13. organizes additional professional education employees of the Agency;

5.3.14. carries out, in accordance with the legislation of the Russian Federation, work on the acquisition, storage, accounting and use of archival documents formed in the course of the Agency's activities;

5.3.15. organizes congresses, conferences, seminars, exhibitions and other events in the established field of activity;

5.3.16. performs other functions of managing state property and providing state services in the established field of activity, if such functions are provided for by federal laws, regulatory legal acts of the President of the Russian Federation or the Government of the Russian Federation;

5.5. performs the functions of the main manager and recipient of federal budget funds provided for the maintenance of the Agency and the implementation of the functions assigned to it.

6. The Federal Agency for Tourism, in order to exercise its powers in the established area of activity, has the right:

6.1. to request and receive, in the prescribed manner, information necessary for making decisions on issues within the competence of the Agency;

6.2. give legal and individuals clarifications on issues within the competence of the Agency;

6.3. involve, in the prescribed manner, for the study of issues related to the scope of the Agency, scientific and other organizations, scientists and specialists;

6.5. set up printed media mass media to publish official announcements, post other materials on issues within the competence of the Agency.

7. The Federal Agency for Tourism is not entitled to exercise control and supervision functions in the established area of activity, except for cases established by decrees of the President of the Russian Federation and decrees of the Government of the Russian Federation.

The restrictions on the powers of the Agency established by the first paragraph of this clause do not apply to the powers of the head of the Agency to resolve personnel issues and issues of organizing the activities of the Agency, as well as to the powers to control activities in the Agency headed by him (his structural units).

III. Organization of activities

8. The Federal Agency for Tourism is headed by a head appointed and dismissed by the Government of the Russian Federation on the proposal of the Minister of Economic Development of the Russian Federation.

The head of the Federal Agency for Tourism is personally responsible for the implementation of the powers assigned to the Agency and the implementation of public policy in the established field of activity.

The head of the Federal Agency for Tourism has deputies appointed and dismissed by the Government of the Russian Federation on the proposal of the Minister of Economic Development of the Russian Federation.

The number of deputy heads of the Agency is established by the Government of the Russian Federation.

9. The structural subdivisions of the Federal Agency for Tourism are the departments for the main directions of the Agency's activities. The departments include departments.

10. Head of the Federal Agency for Tourism:

10.2. presents to the Minister of Economic Development of the Russian Federation:

10.2.1. draft statute on the Agency;

10.2.2. proposals on the maximum number and salary fund for employees of the Agency's central office;

10.2.3. proposals for candidates for the positions of deputy heads of the Agency;

10.2.4. draft annual plan and forecast indicators of the Agency's activities, as well as a report on their implementation;

10.2.5. proposals for submission for awarding state awards of the Russian Federation, Certificate of Honor of the President of the Russian Federation, Certificate of Honor of the Government of the Russian Federation, for encouragement in the form of an announcement of gratitude from the President of the Russian Federation, an announcement of gratitude from the Government of the Russian Federation, on awarding the departmental insignia of the Ministry of Economic Development of the Russian Federation, the right to confer the title "Veteran of Labor", employees of the Agency, subordinate organizations, as well as other persons carrying out activities in the established area;

10.3. approves regulations on structural divisions of the Agency;

10.4. appoints and dismisses employees of the Agency;

10.5. decides, in accordance with the legislation of the Russian Federation on public service, issues related to the passage of the federal public service at the Agency;

10.6. approves the structure and staffing table the central office of the Agency within the limits of the wage fund and the number of employees established by the Government of the Russian Federation, as well as the estimate of expenses for the maintenance of the central office of the Agency within the appropriations approved for the corresponding period provided for in the federal budget;

10.7. submits to the Ministry of Finance of the Russian Federation proposals on the formation of the draft federal budget for the corresponding year in the established field of activity;

10.10. on the basis and in pursuance of the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation issues orders on issues within the competence of the Agency, as well as on issues internal organization work of the Agency.

11. Financing of expenses for the maintenance of the central office of the Federal Agency for Tourism is carried out at the expense of funds provided in the federal budget.

12. The Federal Agency for Tourism is a legal entity, has a seal with the State Emblem of the Russian Federation and with its name, other seals, stamps and letterheads of the established sample, as well as accounts opened in accordance with the legislation of the Russian Federation.

The Federal Agency for Tourism has the right to have a heraldic sign - an emblem, flag and pennant established by the Ministry of Economic Development of the Russian Federation in agreement with the Heraldic Council under the President of the Russian Federation.

13. Location of the Federal Agency for Tourism - Moscow.

The Federal Agency for Tourism (Rosturizm) is an authorized federal executive body that carries out the functions of conducting state policy, legal regulation, providing state services and managing state property in the field of tourism. The activities of Rostourism are managed by the Government of the Russian Federation.

Prior to the adoption of a special regulatory legal act, Rosturizm carries out licensing of tour operator and travel agency activities, as well as activities for the sale of rights to club recreation.
