If the management of the organization has not done this, then the minimum wage agreement applies to them from the date of its official publication and is subject to mandatory execution. For the payment of wages to employees below the established minimum wage, liability is provided under Article 5.27 of the Code of Administrative Offenses of the Russian Federation.

Fine amount, which can be imposed on an organization, ranges from 30 thousand to 50 thousand rubles, and on its head - from 1 thousand to 5 thousand rubles. According to the decree of the President of the Russian Federation Vladimir Putin, from July 1, 2017, the size of the minimum wage (minimum wage) will increase from 7,500 to 7,800 rubles per month, that is, by 4%. What is the minimum wage

The minimum wage from January 1, 2017 is equal to 7,500 rubles

As a rule, the change of the minimum border occurs on the first day of the new year. However, this did not happen in 2017, at this moment the minimum line corresponds to 7,500 rubles, it was established on July 1, 2016.

At the same time, the 2017 minimum wage, adopted in July 2016, began to be displayed on the amount of insurance premiums only from January 1 of the current year. This happened due to the fact that the recalculation of the amount of insurance premiums, according to Russian legislation, can occur once a year.

We all understand that the salary in Moscow or St. Petersburg cannot be compared with wages in Pskov or Togliatti. It was this fact that contributed to the emergence of the concept of a regional minimum wage.

At the same time, the regional minimum wage should be higher than the federal one or equal to it. So minimum wage in Moscow in 2017, 2.3 times more than the federal one.

The process of establishing a regional lower boundary is interesting: it is determined by local authorities after agreement with trade unions and employers. At the same time, if the businessman does not agree with the decision local authorities, he can conduct his business according to the federal border. To do this, he must send a letter to the Labor Inspectorate.

Also, regional figures do not apply to employees employed in companies whose activities are supported by the federal budget.

Regional significance does not affect the amount of benefits and payments.

Minimum wages, insurance payments and benefits

Let's calculate your pension and health insurance payments.

The formula for calculating the size of employee pension insurance payments is as follows:

Minimum wage * 12 months * 26%. Substitute 7,500 into the formula and get 23,400 rubles.

The formula for calculating the amount of health insurance benefits is presented as follows:

Minimum wage * 12 months * 5.1%. Thus, the deduction for the employee's health insurance will amount to 4,590 rubles.

Now let's figure out the terms of insurance payments. When and how to make mandatory payments, each entrepreneur decides for himself. He can make contributions on any day during the year, he can deposit the entire amount at once, or he can make it in installments.

The deadline for paying premiums is on the last business day of each year. Moreover, if December 31 falls on a day off, the last day of payments is transferred to the first business day of the next year.

In addition, those businessmen who receive an annual income of more than 300 thousand rubles are required to pay an additional 1% for pension insurance on income exceeding 300 thousand rubles.

There is also a limit on the maximum amount of pension insurance payments per employee. They should not exceed eight times the minimum wage.

That is, the maximum amount of payments to the pension fund in 2017 will be 60 thousand rubles. And the total amount of payments on account of pension insurance for the year cannot exceed 187,200 rubles.

As for the payments of benefits, the minimum wage affects their volume in the following cases:

  • The employee's experience does not exceed six months
  • An employee's salary is less than the minimum wage

The maternity and pregnancy allowance is calculated using the following formula:

(Number of days of decree * minimum wage * 24 months) / 730 days (two years) and is 34,521.2 rubles for 2017.

Can the salary be lower than the minimum wage

Is it possible to set an employee's salary less than the minimum wage? Oddly enough, the answer to this question is yes.

This is possible in the following cases:

  • An employee works part-time at your company. In these cases, the salary depends on the number of hours worked, and accordingly may be below the established minimum. It is necessary to make a reservation that this state of affairs is possible only with mutual consent and the conclusion of an additional agreement
  • The employee works part-time in the organization. They are initially hired no more than part-time, so they can only receive 50% or less of the minimum wage
  • An employee's salary consists not only of a fixed wage, but also of a monthly bonus and allowances. The employee did not fulfill the monthly quota and the bonus was not due to him according to local act on the accrual of premiums. In this case, the employee will not receive a bonus and his monthly salary will be lower than the minimum wage. But here it is important to prescribe the procedure for paying bonuses (indicators, volume)

Responsibility for wages below the minimum wage

In the event that none of the above conditions are met, but at the same time your employees are paid below the minimum, certain sanctions will await you.

These sanctions take the form of fines. The amount of fines depends on the maliciousness of the violator, that is, the number of violations, as well as on the size of the organization and its legal status.

If you are the head of a department, production, small organization or you are a private entrepreneur, then for violation of the law you will be fined from one to five thousand rubles. If you did not learn your lesson the first time and repeated the violation, then the amount of the fine will vary from ten to twenty thousand rubles.

If you are legal entity, the head large company, then for underpayment to employees you will be fined in the amount of thirty to fifty thousand rubles. If you are caught not for the first time, then the fine will increase and will range from fifty to seventy thousand rubles.

At the same time, remember that the minimum wage in Russia includes not only a fixed salary, but also bonuses, allowances and increments. Therefore, the salary itself may be below the minimum minimum wage (this is not punishable by law), if the total monthly salary of the employee, taking into account all additional payments, reaches the minimum wage.
