What are the types of additional professional education for civil servants

A civil servant can receive additional professional education in the form of:

 professional retraining;

 professional development.

This is stated in part 1 of Article 62 of the Law of July 27, 2004 No. 79-FZ, subparagraph "c" of paragraph 19 of Article 99 of the Law of July 2, 2013 No. 185-FZ.

Grounds for additional education

In what cases it is necessary to send civil servants to receive additional professional education

It is necessary to send a civil servant to receive additional professional education on the following grounds:

 appointment of a civil servant in the order of career growth to another position for competitive basis;

 inclusion of a civil servant in personnel reserve to fill a position on a competitive basis;

 appointment of a civil servant to another position due to job cuts civil service or the abolition of a government agency. In this case, one condition must be met: the employee must receive additional vocational education in that direction of activity and for the position of the civil service to which he is appointed.

Professional retraining

When is it necessary to send civil servants for professional retraining

The state body can also send a civil servant for professional retraining in the following cases:

 the type of professional service activity of a civil servant has changed;

 a civil servant filling a position in the category of “assistants (advisers)”, “specialists” or “supporting specialists” was appointed in the order of career growth to a position in the category “managers”.

The representative of the employer determines the need for retraining of civil servants filling positions of the category (group):

 “leaders” (top and main groups);

 “assistants (advisers)” (of the highest and main groups);

 "specialists" (of the highest and main groups);

 “supporting specialists” (main group).

This is provided for by paragraph 4 of clause 4 of the Regulation approved by the Decree of the President of the Russian Federation of December 28, 2006 No. 1474.

Frequency of professional development

How often is professional development for civil servants carried out?

Further training of a civil servant takes place as needed, but at least once every three years. If he was first hired for a civil service position (before that he worked in organizations, studied), send him to advanced training after graduation probationary period or six months after entering the civil service. In what form can civil servants receive additional professional education?

 with separation from the civil service;

 without separation.

How to organize additional professional education for civil servants

The organization of additional professional education for civil servants is carried out on the basis of a state order (Art. 63 of the Law of July 27, 2004 No. 79-FZ, clause 10 of the Regulation approved by the Decree of the President of the Russian Federation of December 28, 2006 No. 1474). Individual plans are developed for three years in accordance with job regulations in conjunction with the immediate supervisor. They indicate:

 the purpose, type, form and duration of obtaining additional vocational education, including information about the possibility of using distance educational technologies and self-education;

 directions of additional professional education;

 expected performance of additional professional education of a civil servant.

This is stated in clauses 10 and 11 of the Regulations approved by the Decree of the President of the Russian Federation of December 28, 2006 No. 1474.

On the basis of individual plans, a program for the professional development of civil servants of the state body is formed.

Application for training

How to form an application for training a civil servant

By March 1, send to the Ministry of Labor of Russia an application for training federal government civil servants for the next year.

Who approves the state order for additional professional education of civil servants

The state order for additional vocational education is approved by the Government of the Russian Federation no later than three months from the date of entry into force of the law on the federal budget for the corresponding year.

This procedure is established by clauses 13-16 of the Regulations approved by the Decree of the President of the Russian Federation of December 28, 2006 No. 1474.

The state body determines the service provider for professional retraining, advanced training of federal state civil servants in accordance with the Law of April 5, 2013 No. 44-FZ. The procedure for approving, financing and executing the state order for additional professional education of civil servants of the constituent entity of the Russian Federation is regulated by the law (other regulatory legal act) of the constituent entity of the Russian Federation. The same acts establish the powers of state bodies of a constituent entity of the Russian Federation to place a state order. This follows from clause 20 of the Regulations approved by the Decree of the President of the Russian Federation of December 28, 2006 No. 1474.

At the time a civil servant receives additional professional education, he retains the position to be replaced and the salary (clause 2 of the Regulation approved by the Decree of the President of the Russian Federation of December 28, 2006 No. 1474).

The effectiveness of the civil service depends on the professionalism of its employees. Therefore, the law establishes the rights and obligations of the employer in relation to the additional professional education of employees. In particular, paragraphs. 6 p. 1 of Art. 15 of the Federal Law of 27.07.2004 No. 79-FZ "On the State Civil Service of the Russian Federation" (hereinafter - Law No. 79-FZ) stipulates that a civil servant is obliged, among other things, to maintain the level of qualifications necessary for the proper performance of official duties. In the article, we will consider the grounds for additional professional education for civil servants and the specifics of obtaining it.

Additional professional education is carried out through the implementation of additional professional programs (advanced training programs and professional retraining programs). This is enshrined in p. 6 of Order No. 499 , h. 2 tbsp. 76 of Law No. 273-FZ, as well as h. 1 tbsp. 62 of Law No. 79-FZ.

The type, form and duration of receiving additional professional education are established by the representative of the employer, depending on the group and category of the civil service position replaced by a civil servant, in the manner determined Regulations, approved by the Decree of the President of the Russian Federation of December 28, 2006 No. 1474 "On additional professional education of state civil servants of the Russian Federation" (hereinafter - Regulation No. 1474). In accordance with this decree, professional retraining, advanced training and training of civil servants are carried out in accordance with the State requirements for professional retraining, advanced training and training of civil servants of the Russian Federation, approved by Decree of the Government of the Russian Federation dated 06.05.2008 No. 362(Further - Requirements No. 362).

Certain categories of civil servants, in addition to these documents, you should also be guided by other legal acts. Thus, the organization of additional professional education for civil servants of the Federal Agency for Subsoil Use is regulated by the Order of Rosnedra dated January 30, 2015 No. 16-k. By order of the Government of the Russian Federation of 11.09.2008 No. 1307-r the approximate form of the state contract for professional retraining and advanced training of federal state civil servants was approved.

Recall that additional professional programs can be implemented in whole or in part in the form of an internship ( Clause 6 of Regulation No. 1474).

Additional education of an employee is carried out throughout the entire period of his civil service. At the same time, this obligation is carried out by the representative of the employer, who determines the plan of measures related to the additional education of employees, as well as the financing of these measures at the expense of the corresponding budgets.

The grounds for sending a civil servant to additional professional education are:

  1. appointment of an employee to another position in the civil service in the order of official growth on a competitive basis;
  2. inclusion of an employee in the personnel reserve on a competitive basis;
  3. employee certification results;
  4. appointment of an employee to another civil service position in connection with the reduction of civil service positions or the abolition of a state body ( nn. 2 p. 1 art. 31 of Law No. 79-FZ).

Form of study

In accordance with h. 5 art. 17 of Law No. 273-FZ forms of study for additional educational programs and basic programs vocational training are determined by the organization carrying out educational activities independently, unless otherwise provided by the legislation of the Russian Federation.

So, the volume of mastering an additional professional program is regulated p. 12 of Order No. 499:

  • for advanced training programs, the term of development cannot be less than 16 hours;
  • for professional retraining programs - less than 250 hours.
Additional professional education of a civil servant is carried out in any form of training provided for by the legislation on education with or without interruption from the performance of official duties for the civil service position being replaced ( h. 9 art. 62 of Law No. 79-FZ).

According to p. 2 Requirements№ 362 professional retraining and advanced training of civil servants is carried out using the capabilities of distance educational technologies, depending on the categories and groups of positions in the civil service:

  • with a separation from the civil service (professional retraining and advanced training outside the territory of the Russian Federation, internship in the territory of the Russian Federation and abroad);
  • with a partial separation from the civil service (up to three working days a week);
  • without separation (evening groups) from the state civil service of the Russian Federation.

Requirements No. 362 contain provisions on the passage of professional retraining and advanced training of civil servants with partial separation from the civil service. However, in this part, the requirements cannot be applied, since Federal Law No. 185-FZ the form of additional professional education with a partial separation from the state civil service has been abolished.

Professional retraining and advanced training of civil servants outside the normal length of service time are carried out in accordance with the legislation of the Russian Federation.

It should be noted that the choice of the form of training depends on the amount of information received and the location of the body or organization in which the civil servant carries out additional education.

However, in this case, one must take into account Clause 3 of Requirements No. 362, according to which the total volume of the classroom teaching load of civil servants per week should be:

  • when training with a separation from service - no more than 41 hours, taking into account the volume of the training load no more than 54 hours;
  • for on-the-job training - at least 12 hours.

Professional retraining

According to Clause 9 of Requirements No. 362, as well as Clause 4 of Regulation No. 1474 professional retraining of civil servants means the acquisition additional knowledge and the skills necessary for civil servants to carry out a new type of professional service.

That is, the purpose of professional retraining is to perform a new type professional activity or obtaining additional qualifications.

It should be noted that employees who fill the positions of the civil service of the category "assistants (advisers)", "specialists" or "providing specialists" are sent for professional retraining, if they are appointed in the order of career growth to a civil service position in the category "managers". In this case, based on the results of professional retraining, employees may be awarded additional qualifications.

At the same time, the need for professional retraining by employees replacing civil service positions of the category "managers", "assistants (advisers)" or "specialists" belonging to the highest and main groups of positions, as well as positions of the category "providing specialists" belonging to the main group positions, with the assignment of additional qualifications to them is determined by the employer.

For professional retraining, the following terms for mastering educational programs are established:

  • more than 500 classroom hours for civil servants to perform a new type of professional activity;
  • more than 1,000 hours (of which 75% are classroom) for additional qualifications ( Clause 12 of Requirements No. 362).
It should be remembered that when mastering a professional retraining program, a civil servant can be credited with advanced training programs (internships), the development of which is confirmed by documents state standard received no later than three years before the start of training under the relevant professional retraining program.

Upon completion of educational programs for professional retraining, mandatory state final certification is carried out, which provides for final qualification (certification) work and an exam.

The positive results of this certification give the right to receive a diploma:

  • on professional retraining - for persons who have completed training under a program of more than 500 classroom hours;
  • on additional (to higher) education - for persons who have completed training in an additional professional educational program to obtain additional qualifications of more than 1,000 hours (in this case, a civil servant may apply for positions, the qualification requirements for which correspond to the profile of the education received).

Training

In accordance with Clause 17 of Requirements No. 362 upgrading the qualifications of civil servants is updating the knowledge and improving the skills of civil servants with vocational education, in connection with the increased requirements for the level of their qualifications and the need for them to master new ways of solving professional problems.

According to Clause 5 of Regulation No. 1474 a civil servant who is first recruited into the civil service is sent for advanced training after a probationary period or six months after entering the civil service. This norm is aimed, in particular, at studying the specifics of civil servants' service in a particular state body.

Employees are sent for advanced training if they are appointed in the order of career growth to a civil service position in another group within the same category of positions.

In a planned manner, professional development of a civil servant is carried out as needed, but at least once every three years ( h. 5 art. 62 of Law No. 79-FZ).

Further training can take place:

  • in a short-term form (from 18 to 72 classroom hours) in order to master changes in specific issues of professional activity;
  • in the form of a comprehensive update of knowledge for solving relevant professional tasks (ranging from 73 to 144 classroom hours). In this case, by analogy with professional retraining, a civil servant can be credited with sections of the short-term professional development program, the development of which is confirmed by state-recognized documents received no later than three years before the start of training under the relevant advanced training program.
The final stage advanced training is the final certification, after successful completion of which government officials are issued documents of the state standard: either a certificate of short-term advanced training, or a certificate of advanced training ( Clause 21 of Requirements No. 362).

Internship

According to Requirements№ 362 internship implies the consolidation of theoretical knowledge gained by civil servants in the development of professional retraining or advanced training programs, and the acquisition of practical skills and abilities for their effective use in the performance of their official duties.

We have already noted that in accordance with Clause 6 of Regulation No. 1474 additional professional programs can be implemented in whole or in part in the form of an internship. This is indicated in h. 12Art. 76 of Law No. 273-FZ.

That is, in Law No. 273-FZ internship is highlighted as a form of implementation of additional professional programs, and not as separate species additional professional educational program. This is stated, for example, in letters of the Ministry of Education and Science of the Russian Federation dated 09.10.2013 No. 06-735 and Ministry of Labor of the Russian Federation of July 31, 2013 No. 18-3 / 10 / 2-4297... By virtue of Clause 13 of Order No. 499 the terms of the internship are determined by the organization independently based on the training goals. The duration of the internship is agreed with the head of the organization where it is held.

An internship can be individual or group in nature and provide for such types of educational activities as working with educational publications, acquiring professional and organizational skills, working with technical, regulatory and other documentation, etc.

Based on the results of the internship, the student is issued a qualification document depending on the additional professional program being implemented.

Additional professional education outside the Russian Federation

Part 8 of Art. 62 of Law No. 79-FZ established the right of a civil servant to receive additional professional education outside the territory of the Russian Federation, which provides for the acquisition of knowledge about foreign experience government controlled and mastering new professional skills and abilities.

According to sect. V Requirements No. 362 study abroad is carried out in accordance with international treaties and on the basis of contracts concluded by a government agency for managing the civil service or an educational institution, determined in accordance with the legislation of the Russian Federation on placing orders, with foreign government agencies, organizations and educational institutions, as well as with international organizations (hereinafter referred to as foreign partners).

The need for study abroad is determined by the employer's representative.

At the same time, employees with more than two years of civil service experience have an advantage when sending them to study abroad, with more than one year in a substituted position. At the same time, educational programs of study abroad may provide for the preliminary training of employees.

The duration of training is established by agreement with foreign partners based on the goals and content of training and cannot exceed the duration of training determined for the corresponding types of additional professional education (including periods preliminary preparation and final certification).

In the case of advanced training abroad, civil servants must be trained in groups of no more than 10 people. At the same time, students in groups (if necessary) are provided with translation services.

Professional retraining and internship are carried out individually. In this case, a prerequisite for civil servants is knowledge foreign language where teaching is conducted.

State order for professional retraining and advanced training

The plan for retraining and advanced training of civil servants is implemented at the expense of the federal budget allocated for the execution of the state order ( Art. 63 of Law No. 79-FZ). Accordingly, purchases of goods, works, services under the state order are carried out in the manner prescribed by Federal Law of 05.04.2013 No. 44-FZ"O contract system in the field of procurement of goods, works, services to meet state and municipal needs. "

By virtue of h. 4 tbsp. 63 of Law No. 79-FZ the state order for additional professional education of federal civil servants, including its volume and structure, is approved by the Government of the Russian Federation after the entry into force of the federal law on the federal budget for the corresponding year. Note that the state order is approved separately for each state body, indicating the number of federal civil servants sent for training, as well as the amount of funding provided for in the federal budget for such training. For 2015, the state order for additional professional education of federal state civil servants is approved By the Order of the Government of the Russian Federation dated 06.03.2015 No. 370-r.

For additional professional education of civil servants of the constituent entity of the Russian Federation, the state order is approved by law or other regulatory legal act of the constituent entity of the Russian Federation.

Article 62. Professional retraining, advanced training and internship of a civil servant

Additional professional education is referred to the basic rights of civil servants filling civil service positions included in the Register of Federal State Civil Service Positions and the Registers of Civil Service Positions of the constituent entities of the Russian Federation, in a federal state body, a state body of a constituent entity of the Russian Federation or their apparatuses.

The employer's representative and the educational institution or other organization to which civil servants are sent for professional retraining, advanced training or internship, provide the necessary conditions for the development by employees of educational programs of additional professional education.

For a civil servant, during the period of receiving additional professional education, a substituted position and salary are retained.

The grounds for sending a civil servant to study in an educational program are:

c) the decision of the certification commission on the conformity of the civil servant to the civil service position being replaced, provided that he successfully masters the educational program.

In addition to the listed reasons, professional retraining of a civil servant is carried out in the event of a change in the type of his professional service.

For professional retraining, a civil servant is sent to fill a civil service position of the "assistants (advisers)", "specialists" or "support specialists" category, in the case of his appointment in the order of career growth to a civil service position of the "managers" category.

Based on the results of professional retraining, an additional qualification may be awarded to a civil servant.

The need for professional retraining of civil servants who fill the positions of the civil service of the category "managers", "assistants (advisers)" or "specialists" related to the highest and main groups of positions, as well as positions of the civil service of the category "providing specialists" related to the main a group of positions, with the assignment of additional qualifications to them, is determined by the representative of the employer.

Professional development of a civil servant is carried out as necessary, determined by the representative of the employer, but at least once every three years.

Internship of a civil servant is carried out as required, determined by the representative of the employer. The purpose of the internship, which takes place in government agencies or other organizations, is:

a) study of advanced, including foreign, experience;

b) consolidation of theoretical knowledge gained by civil servants during the period of professional retraining or advanced training, and the acquisition of practical skills and abilities for their effective use in the performance of his official duties.

An internship can be both an independent type of additional professional education of a civil servant, and an integral part of his professional retraining or advanced training. Internships for civil servants are carried out in isolation from the state civil service. An internship, which is an independent type of additional professional education for a civil servant, is organized by a representative of the employer together with a state body or other organization to which he is sent for an internship, with the participation of an educational institution in the manner determined by the Government of the Russian Federation.

Professional retraining and advanced training of civil servants filling positions in the civil service of the category "managers" belonging to the highest group of positions are carried out with a separation, with partial separation or without separation from the public civil service and using the capabilities of distance educational technologies. Professional retraining and advanced training of civil servants filling positions in the civil service of the category "assistants (advisers)" or "specialists" belonging to the highest group of positions, as well as positions of the civil service of the category "managers", "assistants (advisers)", "specialists" or "support specialists", belonging to the main and leading groups of positions, are carried out in isolation or with partial separation from the civil service. Professional retraining and advanced training of civil servants filling other positions in the civil service are carried out in isolation from the civil service.

The terms of training civil servants in educational programs are established by the employer's representative on the basis of the standards for the duration of educational programs in accordance with state requirements for professional retraining, advanced training and internship of civil servants, approved in the manner determined by the Government of the Russian Federation of May 6, 2008 N 362, which approved state requirements for professional retraining, advanced training and training of civil servants. State requirements entered into force on January 1, 2009 and are mandatory for everyone educational institutions higher, secondary and additional professional education located on the territory of the Russian Federation and providing training for civil servants.

In accordance with state requirements, additional vocational education of civil servants is education based on higher or secondary vocational education, carried out in educational institutions of higher, secondary and additional vocational education with state accreditation, as well as directly in state bodies or other organizations, aimed at continuous professional development civil servants. At the same time, educational institutions that implement programs of additional professional education for civil servants independently determine their content and training technology.

State requirements provide that professional retraining and advanced training of civil servants can be carried out with a separation, with a partial separation (up to three working days a week) or without separation (evening groups) from the civil service and using the possibilities of distance educational technologies, depending on the categories and groups of positions of the civil service.

In the state requirements, the concept of "internship" is disclosed. In particular, an internship is the study of advanced experience by civil servants, including foreign ones, as well as the consolidation of theoretical knowledge acquired by a civil servant in the development of professional retraining or advanced training programs, and the acquisition of practical skills and abilities for their effective use in the performance of their official duties. ... The duration of the internship, which is an independent type of additional professional education for civil servants, can vary from 2 to 4 months. At the same time, the duration of an internship, which is an integral part of professional retraining or advanced training programs, is determined by the curriculum of the corresponding programs. Internship for civil servants on the territory of the Russian Federation and abroad is carried out with separation from civil service. The state requirements define the features of the organization of additional professional education for civil servants outside the territory of the Russian Federation, and consolidate the functions of the state body for managing the civil service and the educational institution when organizing this education abroad.

The organization of professional retraining, advanced training and training of civil servants is carried out on the basis of a state order. The state order for professional retraining, advanced training and training of civil servants is formed taking into account the programs of state bodies for the professional development of civil servants, based on individual plans for the professional development of civil servants.

An individual plan for the professional development of a civil servant is developed by him in accordance with job regulations together with the immediate supervisor for a period of three years and approved in the manner established by the representative of the employer. The individual plan indicates:

a) the purpose, type, form and duration of additional professional education, including information about the possibility of using distance educational technologies and self-education;

b) directions of additional professional education;

c) the expected performance of additional professional education of a civil servant.

The program of the state body for the professional development of civil servants is approved by its head in agreement with the relevant state body for managing the civil service in the manner determined by the Government of the Russian Federation.

In a three-year program:

a) the annual need for professional retraining, advanced training and internship of civil servants is predicted by categories and groups of civil service positions, directions, types, forms and duration of additional professional education, taking into account the profile and type of educational institutions;

b) the stages of program implementation, a list of activities, as well as indicators that allow assessing the progress and results of its implementation are indicated;

c) the expected performance of additional professional education of civil servants is predicted.

The system of training civil servants should be built on a differentiated approach in accordance with the positions held, taking into account the categories and groups of positions. Differentiated curricula and individual training systems are effectively implemented in the preparation of civil servants for qualification exams. It seems promising to introduce into the activities of educational institutions of additional education a unified unified system of organizing the educational process, designed for a two-year educational program with the organization of internships in federal bodies executive power, authorities of the constituent entities of the Federation and bodies local government... Equally important is the formation of a system of social and professional adaptation of graduates of higher education institutions in their subsequent professional activities in the civil service.

Additional professional education of civil servants outside the territory of the Russian Federation is organized with the aim of acquiring knowledge about foreign experience in public administration and mastering new professional skills and abilities necessary for the performance of official duties. The need for study abroad is determined by the employer's representative based on:

a) promising areas of activity of the state body and its structural divisions;

The duration of study abroad is established by agreement with foreign partners, based on the goals and content of training, and cannot exceed the duration of study established for the corresponding types of additional professional education (including periods of preliminary training and final certification).

Civil servants who carry out advanced training abroad are trained in groups of no more than 10 people. Professional retraining and training abroad are carried out individually.

For civil servants studying in groups, translation services are available if necessary. For civil servants sent individually to study abroad, knowledge of the foreign language in which teaching is carried out is a prerequisite.

On January 25, 2008, the President of the Russian Federation adopted Order N 28-RP "On the organization of additional professional education for federal state civil servants outside the territory of the Russian Federation in 2008-2010."

In accordance with this decree, the priority areas of additional professional education for civil servants outside the territory of the Russian Federation and the composition of groups of civil servants sent abroad are approved by the Administration of the President of the Russian Federation.

After the approval by the Government of the Russian Federation of the state order for additional professional education of federal civil servants for the corresponding year, the placement of a state order for additional professional education of civil servants in 2008-2010 outside the territory of the Russian Federation will be carried out at the Russian Academy of Civil Service under the President of the Russian Federation. To this end, the Russian Academy of Public Administration under the President of the Russian Federation has been instructed to develop and implement with the participation of Russian and foreign educational institutions and various organizations educational programs, including preliminary training of civil servants before being sent abroad and their final certification. For civil servants who have successfully mastered the programs of additional professional education outside the territory of the Russian Federation, the Russian Academy of State Service under the President of the Russian Federation ensures the issuance of a document on additional professional education of the state standard.

In accordance with,, and 71 of the Federal Law of July 27, 2004 N 79-FZ "On the state civil service of the Russian Federation" and in order to improve the system of additional professional education of state civil servants of the Russian Federation

I decree:

1. To approve the attached Regulations on the procedure for obtaining additional civil servants of the Russian Federation.

2. Establish that:

a) before the formation of the federal state body for the management of the civil service:

the functions provided for by the Regulations approved by this Decree are performed by the federal executive body authorized by the Government of the Russian Federation;

financing of the state order for additional professional education of federal state civil servants is carried out at the expense of budgetary allocations provided in the federal budget to the federal executive body authorized by the Government of the Russian Federation;

b) before the formation of state bodies for managing the civil service of the constituent entities of the Russian Federation, the functions of these bodies provided for by the Regulations approved by this Decree are carried out by the state bodies of the constituent entities of the Russian Federation in accordance with the legislation of the constituent entities of the Russian Federation;

c) in 2007, the procedure for obtaining additional vocational education by the state, provided for by the Regulations approved by this Decree, applies to the organization of professional retraining, advanced training and internships for these employees, carried out from January 1, 2008.

3. To the Government of the Russian Federation:

a) when drafting the federal budget for the corresponding year and for the planning period, provide for budgetary allocations for financing the state order for additional professional education of federal state civil servants, including for obtaining additional professional education by these employees outside the territory of the Russian Federation;

b) approve the state order for additional professional education of federal state civil servants within the budgetary allocations provided for in the federal budget for the corresponding year;

d) ensure approval within 3 months:

regulations on the program of the state body for the professional development of civil servants of the Russian Federation and approximate form programs;

an approximate form of a state contract for professional retraining and advanced training of federal state civil servants.

Regulations on the procedure for obtaining additional professional education by state civil servants of the Russian Federation

1. These Regulations in accordance with, and 63 of the Federal Law of July 27, 2004 N 79-FZ "On the State Civil Service of the Russian Federation" determine the procedure for obtaining additional professional education by state civil servants of the Russian Federation (hereinafter referred to as civil servants) who fill the positions of state civil service of the Russian Federation (hereinafter - civil service positions) included in the Register of positions of the federal state civil service and registers of positions in the state civil service of the constituent entities of the Russian Federation, in the federal state body, state body of the subject of the Russian Federation or their apparatuses, as well as the procedure for obtaining civil employees of additional professional education both on the territory of the Russian Federation and abroad. *one)

2. The head of a state body, a person replacing a public office of the Russian Federation or a public office of a constituent entity of the Russian Federation, or a representative of the said head or a person exercising the powers of the employer on behalf of the Russian Federation or the constituent entity of the Russian Federation (hereinafter referred to as the representative of the employer), a professional educational organization, educational organization of higher education and organization of additional professional education (hereinafter - educational organization), a state body or other organization to which civil servants are sent for professional retraining or advanced training, the necessary conditions are provided for the development of additional professional programs by these employees.

For a civil servant, during the period of receiving additional professional education, a substituted position and salary are retained.

3. The grounds for sending a civil servant for training in an additional professional program are:

a) the appointment of a civil servant in the order of career growth to another position in the civil service on a competitive basis;

b) the inclusion of a civil servant in the personnel reserve to fill a civil service position on a competitive basis;

c) the decision of the attestation commission on the civil servant's compliance with the civil service position being replaced, provided that he successfully masters an additional professional program.

d) the appointment of a civil servant to another position in the civil service in accordance with paragraph 2 of part 1 of article 31 of the Federal Law of July 27, 2004 N 79-FZ "On the state civil service of the Russian Federation.

4. Professional retraining of a civil servant is carried out taking into account the profile of his education in the cases provided for in paragraph 3 of this Regulation, as well as in the case of a change in the type of his professional service.

A civil servant filling a civil service position of the "assistants (advisers)", "specialists" or "support specialists" category, in the case of his appointment in the order of career growth to a civil service position of the "managers" category, is sent for professional retraining.

Based on the results of professional retraining, an additional qualification may be awarded to a civil servant.

The need for professional retraining of civil servants who fill the positions of the civil service of the category "managers", "assistants (advisers)" or "specialists" related to the highest and main groups of positions, as well as positions of the civil service of the category "providing specialists" related to the main a group of positions, with the assignment of additional qualifications to them, is determined by the representative of the employer.

5. Advanced training of a civil servant is carried out in the cases provided for in paragraph 3 of this Regulation, as necessary, determined by the representative of the employer, but at least once every three years.

A civil servant who is first recruited into the civil service is sent for advanced training after a probationary period or six months after entering the civil service. * 5.2)

A civil servant, in the event of his appointment in the order of career growth to a civil service position of another group within the same category of positions, is sent for advanced training.

6. Additional professional programs can be implemented in whole or in part in the form of an internship.

Professional retraining and advanced training of civil servants can be carried out using distance learning technologies.

8. Professional retraining and advanced training of civil servants are carried out with or without separation from the performance of official duties for the civil service position being replaced.

9. The term of training for civil servants on the additional professional program is determined by this program and (or) the contract on education.

10. Organization of professional retraining and advanced training of civil servants is carried out on the basis of a state order for additional professional education.

The state order for additional professional education of civil servants is formed taking into account the programs of state bodies for the professional development of civil servants, based on individual plans for the professional development of civil servants.

c) the expected performance of additional professional education of civil servants is predicted.

13. The federal state body for the management of the civil service, on the basis of applications for the training of federal state civil servants on additional professional programs, which are drawn up by federal state bodies in the form according to Appendix No. 1 and are submitted no later than March 1 of the year preceding the planned one, determines the structure of the state order for additional professional education of federal state civil servants (hereinafter referred to as federal civil servants) and calculates the amount of its funding.

The application is formed by the federal state body on the basis of economic standards for the cost of educational services for professional retraining, advanced training of federal civil servants and the projected number of these employees sent for training, by groups and categories of positions in the federal state civil service, types, forms and terms of obtaining additional professional education in accordance with the program of the federal state body for the professional development of federal civil servants. The application is accompanied by an explanatory note justifying the main directions of additional professional education for federal civil servants based on the long-term goals and objectives of the relevant federal state body that sends these employees for professional retraining, advanced training. * 13.2)

14. During the formation of the federal budget for the corresponding year, but no later than May 1 of the year preceding the planned one, the federal state body for managing the civil service submits to the Government of the Russian Federation the proposals agreed with the Administration of the President of the Russian Federation:

a) on the amount of financing of the state order for additional professional education of federal civil servants for the corresponding year with the necessary justifications;

b) o priority areas additional professional education of federal civil servants based on the long-term goals and objectives of federal state bodies.

15. State order for additional professional education of federal civil servants, with the exception of federal civil servants of federal ministries, whose activities are managed by the Government of the Russian Federation, federal services and federal agencies subordinate to these federal ministries, as well as federal services and federal agencies, whose activities are managed by the Government of the Russian Federation, shall be coordinated by the federal state body for managing the civil service with the Administration of the President of the Russian Federation.

The state order for additional professional education of federal civil servants is submitted by the federal state body for the management of the civil service in the form according to Appendix No. 2 to the Government of the Russian Federation, which approves it no later than 3 months from the date of entry into force of the federal law on the federal budget for corresponding year.

16. The state order for additional professional education of federal civil servants contains information:

a) on the number of federal civil servants sent for training in additional professional programs, including additional professional programs for professional retraining and advanced training, on the territory of the Russian Federation;

b) on the amount of budgetary allocations provided in the federal budget for additional professional education of federal civil servants, including for professional retraining and advanced training, on the territory of the Russian Federation;

c) on the number of federal civil servants sent for training in additional professional programs outside the territory of the Russian Federation;

d) on the amount of budgetary allocations provided in the federal budget for additional professional education of federal civil servants outside the territory of the Russian Federation;

e) on the scientific-methodological, educational-methodical and information-analytical support of additional professional education for federal civil servants;

f) on the total amount of funds for the implementation of the state order for additional professional education of federal civil servants.

17. The organization of the execution of the state order for additional professional education of federal civil servants for the corresponding year outside the territory of the Russian Federation is carried out by the federal state body for the management of the civil service.

The subject-matter content of additional professional programs to be mastered by federal civil servants outside the territory of the Russian Federation, and the list of foreign states to which federal civil servants are sent for training under these programs, are coordinated by the federal state body for the management of civil service with the Administration of the President of the Russian Federation and Office of the Government of the Russian Federation.

Candidates for federal civil servants of federal ministries, whose activities are managed by the Government of the Russian Federation, federal services and federal agencies subordinate to these federal ministries, as well as federal services and federal agencies, whose activities are managed by the Government of the Russian Federation, recommended for referral to training in additional professional programs outside the territory of the Russian Federation, are coordinated by the federal state body for the management of civil service with the Office of the Government of the Russian Federation.

Federal civil servants' candidates recommended for sending to training in additional professional programs outside the territory of the Russian Federation, including candidates approved by the Office of the Government of the Russian Federation, are coordinated by the federal state body for civil service management with the Administration of the President of the Russian Federation.

18. Procurement of services for additional professional education of federal civil servants within the territory of the Russian Federation is carried out by federal state bodies with the participation of the federal state body for managing the civil service in organizations carrying out educational activities on additional professional programs, in the manner prescribed by the legislation of the Russian Federation on the contract system in the field of procurement of goods, works, services to meet state and municipal needs.

The federal state body (customer) together with the federal state body for the management of the civil service, on the one hand, and the organization carrying out educational activities for additional professional programs, determined in accordance with the legislation of the Russian Federation on the contract system in the field of procurement of goods, works, services for ensuring state and municipal needs (executor), on the other hand, conclude a state contract for professional retraining or advanced training of federal civil servants in the form approved by the Government of the Russian Federation.

The state contract for professional retraining or advanced training of federal civil servants must contain required condition on reimbursement by the federal state body for managing the civil service of an organization carrying out educational activities for additional professional programs, the costs of professional retraining or advanced training of these employees.

19. Procurement of services for additional professional education of federal civil servants in terms of performance of work, provision of services related to scientific and methodological, educational, methodological and information and analytical support of additional professional education, is carried out by the federal state body for the management of public service in educational and scientific organizations in the manner prescribed by the legislation of the Russian Federation on the contract system in the field of procurement of goods, works, services to meet state and municipal needs.

20. The procedure for approval, financing and execution of a state order for additional professional education of civil servants of a constituent entity of the Russian Federation, as well as the powers of state bodies of a constituent entity of the Russian Federation to place a state order, are established by law or other regulatory legal act of a constituent entity of the Russian Federation, taking into account these Regulations.

21. Control over the execution of the state order for additional professional education of federal civil servants and state orders for additional professional education of civil servants of the constituent entities of the Russian Federation is carried out, respectively, by the federal state body for managing the civil service and state bodies for managing the civil service of the constituent entities of the Russian Federation.

The state bodies for the management of the civil service of the constituent entities of the Russian Federation annually submit to the federal state body for the administration of the civil service information on the results of the execution by the state bodies of the constituent entities of the Russian Federation of state orders for additional professional education of civil servants of the constituent entities of the Russian Federation.

The article examines the main indicators of the state of additional professional education of civil servants. The dynamics of the execution of the state order for their vocational training is shown. Recommendations for improving the efficiency and quality of training for civil servants in modern conditions are considered.

Personnel Management Dictionary. Additional professional education of a civil servant on the basis of Art. 62 of the Federal Law of 27.07.2004 N 79-FZ "On the State Civil Service of the Russian Federation" includes professional retraining, advanced training and internship. The grounds for sending a civil servant for professional retraining, advanced training or internship are:

1) the appointment of a civil servant to another position in the civil service in the order of official growth on a competitive basis;

2) the inclusion of a civil servant in the personnel reserve on a competitive basis;

3) the results of certification of a civil servant.

The current stage in the development of the civil service necessitates an increase in the professionalism of civil servants, adequate to the needs of public authorities. In this regard, scientific research on the problems of the state of additional professional education (hereinafter referred to as APE) of civil servants and their professional development has practical relevance for the civil service carrying out its activities in the conditions of socio-economic and financial crisis... This can only be achieved through a more effective state strategy in the field of continuing education based on scientific research and innovative teaching methods. At the same time, studies carried out by the Academy of National Economy under the Government of the Russian Federation showed that the CVE system does not meet modern requirements, and its scale is insufficient to meet the need for advanced training and retraining of personnel (including civil servants). The Federal Program "Reforming and Development of the Civil Service System of the Russian Federation (2009-2013)" emphasizes that "the quality of professional training of civil servants does not sufficiently meet the needs of the development of the civil service."

Analysis of the statistical data of the current state of APE of civil servants allowed us to identify trends in the unstable functioning of APE. In particular, there was a mismatch between market demand and the low level of content of educational programs to meet them. This discrepancy gave rise to a number of problems in the CPE system of civil servants that require their solution.

The first problem is the presence of unresolved issues related to the planning and implementation of organizational measures for the training of civil servants for calendar year... The fact is that the organizers of the advanced training course for civil servants very late receive from the Government Office and other state structures a state order for additional vocational training for civil servants.

The second problem is a significant increase in the volume of training of civil servants, since each of them must undergo appropriate training once every three years. This requires a completely different amount of financial, material, technical and personnel support for additional vocational education.

The third problem is clearly insufficient funding for the system of additional professional education. Effective from January 1, 2009, the economic standards for the cost of educational services under the continuing education programs of civil servants, even after their double increase, still remain insufficient. It should be noted that these economic standards were approved by the Decree of the Government of the Russian Federation of May 26, 2008 N 393 "On determining the size of the cost of educational services in the field of additional professional education of federal state civil servants and annual deductions for its scientific and methodological, educational, methodological and information and analytical support. ". In accordance with the economic standards of the cost of educational services for additional training of civil servants for the category of managers, it is a little more than 128 rubles, assistants (advisers) and specialists of the highest, main, leading and senior group positions - 105 rubles, providing specialists junior group posts - 83.6 rubles.

The fourth problem is the preservation of the traditional training of civil servants, whose professional education does not correspond qualification requirements.

The aforementioned problems are due to the general state of APE of civil servants. Let's highlight its main indicators.

1. Quantitative indicators of training of civil servants. Their analysis allows us to draw the following conclusions:

firstly, the analysis of the ratio of the number of civil servants who underwent training under the programs of additional vocational education in 2007-2008 indicates that in 2008 its decline is observed (tab. 1);

secondly, the analysis of the execution of the state order by the ministries of the Russian Federation in 2008 showed that the ministries did not fully fulfill the plan for the additional vocational education of civil servants; the number of those trained is lower than the number of civil servants to be trained. Among the ministries that have overfulfilled the training plan, the Ministry of Economic Development of Russia should be attributed - 1047 people were trained, and it was planned - 788 people; The Ministry of Finance of Russia - 330 and 283 people, respectively;

thirdly, the work of the ministries for additional vocational training of civil servants influenced the implementation of the state order plan for professional retraining and advanced training of civil servants of the relevant federal services and agencies. Federal services and agencies that have exceeded the plan for the execution of the state order include: the Federal Migration Service, the Federal Service for Supervision of Consumer Rights Protection and Human Welfare, Federal agency water resources, Federal Agency for Subsoil Use, Federal Service for Veterinary and Phytosanitary Supervision, Federal tax office, Federal Treasury, Federal State Statistics Service, Federal Agency for the Management of Special Economic Zones. The number of federal services and agencies that did not fulfill the plan (not a single person was trained) of the state order include: federal Service for supervision of compliance with legislation in the field of cultural heritage protection, Federal Service for Supervision of Communications and Mass Media, Federal Agency for State Property Management, Higher Court of Arbitration RF. It was planned to train 1150 people in these bodies, but practically not a single person was trained.

2. Financial performance... Their analysis shows that:

first, the volume of budget allocations for 2008 allocated in accordance with the state order for professional retraining, advanced training and training of federal civil servants has not been fully utilized (Table 2);

secondly, of the 85 federal executive bodies that participated in the execution of the state order in 2008, 32 federal executive bodies (38% of the total number of participants in the state order) fully utilized the budget allocations allocated to them. A similar situation was observed in 2007. In total, in 2007, out of 695,734.9 thousand rubles, provided for the payment of training for civil servants, the federal executive authorities mastered 644,700.37 thousand rubles. (92.66% of the total budgetary allocations provided for the fulfillment of the tasks of the state order for 2007). Not mastered 51,034.53 thousand rubles. budget allocations;

thirdly, the main reasons for the partial non-utilization of the allocated funds are as follows:

Due to the lack of staffing in the majority of federal executive bodies, the planned training in professional retraining programs for civil servants is being replaced by training in advanced training programs;

The work of individual federal executive bodies with a network is not well organized. territorial bodies, on the organization of the DPO of civil servants of the relevant territorial bodies.

3. Indicators of the dynamics of APE of civil servants. They make it possible to identify trends and patterns in this area, as well as to develop on their basis the appropriate management decisions... In our case, such an analysis was carried out for the period from 2004 to 2008. (Table 3).

Based on the analysis of the dynamics of the CPE system of civil servants for the period from 2004 to 2008. the following conclusions can be drawn:

During the period under study, there has been a steady increase in budgetary allocations allocated from the federal budget for the execution of state order assignments, as well as in the number of federal executive bodies participating in the state order. In addition, positive dynamics persists in the main indicator of the implementation of the state order - the number of civil servants who have successfully mastered the programs of additional professional education within the framework of the state order;

Positive dynamics persists in the volume of financing of the state order for the training of civil servants. In 2007 relative to 2004, the growth was 908.4%, i.e. more than 9 times. The largest volume of financing was in 2006, the growth in relation to 2005 amounted to 573.8%. This fact of growth can be explained by the adoption in 2004 of the Federal Law "On the State Civil Service of the Russian Federation", which determined the procedure and terms for training civil servants once every three years. This required a significant increase in funding. In 2008, the volume of financing amounted to 74.7% of the state order;

An increase in the number of training for civil servants is also observed in 2006 (576.9%), which is associated with the formation of federal executive bodies and the reorganization organizational structure state civil service, its reform, as well as administrative reform;

In 2008, as compared to 2004, the number of federal executive bodies participating in the state order for additional vocational education of civil servants increased by more than 1.5 times (from 54 to 85);

Despite the positive dynamics of the indicators of the state order for the training of civil servants, there is a decrease in the average cost of training per student. So, for example, if in 2004 it amounted to 6779 rubles, then in 2005 there is a decrease to the level of 5914 rubles. and 5881 rubles. in 2006 And only in 2007, the average cost of training per student increased and amounted to 6426 rubles. (this is approximately the level of 2004). In 2008, the average cost of training per student decreased and amounted to 5249 rubles;

The situation is similar with the cost of the norm of one academic hour (based on the advanced training program in the amount of 72 hours). In 2004, it amounted to 94 rubles, in 2005 - 82 rubles, in 2006 - 81.7 rubles, in 2007 - 89.3 rubles, i.e. did not reach the level of 2004. In 2008, the average cost of one academic hour of study decreased by 18.4%.

Thus, the process of additional training for civil servants must be formed taking into account the programs of state bodies for the professional development of civil servants, based on individual plans for their professional development. It is necessary to introduce new mechanisms into the continuing education system of civil servants to ensure the effective use of available resources and improve the quality of education based on updating its structure, content and learning technologies.
