Algorithm for obtaining an electronic signature

I decided to start my article with a description of the sequence of steps that you need to follow in order to receive an EDS.

  1. Choose which electronic signature (ES) you need.

Step 3. Filling out the application

Step 4. Paying the bill

- certificate of registration with tax authority(TIN);

If the electronic signature is made in the name of the head of the organization, then it is also necessary to provide a document on the appointment of the head with his signature and seal of the organization;

If the owner of the electronic signature is not the first person, but an employee of the organization (its authorized representative), then it is necessary to provide as part of the documents a power of attorney to transfer powers to such an employee with the signature of the head and the seal of the organization;

If the documents are submitted or received by electronic signature not by the owner of the electronic signature, but by an authorized representative of a legal entity, then it is necessary to provide a power of attorney for the transfer of functions to him with the signature of the head and the seal of the organization, as well as an identity card (passport of a citizen of the Russian Federation) of such a representative.

- certificate of state registration of individual entrepreneurs;

If the owner of the electronic signature transfers all the functions of obtaining it to his authorized representative, then the list of required documents also includes the identity card (passport of a citizen of the Russian Federation) of this authorized representative.

Step 6. Receiving the electronic signature

You can get an electronic signature at any convenient point of issue of the CA, providing the originals of all necessary documents. The originals will only be needed to verify the information and then will be returned to you.

- registration and issue of the ES key certificate;

- granting the rights to work with specialized software;

The term for the production of an electronic signature

The production time of the electronic code depends entirely on yourself, i.e. on how quickly the necessary package of documents will be prepared and transferred to the CA and the payment for this service is made. Someone can get an EDS in 1 hour, while for someone it can take from several days to one week. But the average time for issuing an EDS for most CAs is 2-3 working days. The term for issuing an extract from the Unified State Register of Legal Entities or USRIP to the IFTS is 5 working days. Therefore, take care of receiving it in advance.

EDS validity period

Keep in mind that the EDS validity period is exactly 1 year. Those. EDS must be reissued every year. You can extend the EDS in the same CA where you received it, or apply for issue in another CA.

What does an electronic signature look like?

  • Collect the required documentation package;
  • Get EDS.

Step 1. Choose the type of signature that suits you best.

This is due to the fact that it can confirm not only the identity of the person who sent the document, but is also protected to the maximum. Step 3. We fill out an application.

EDS documents

When collecting documents important nuance is the following: EDS is needed for an individual, EDS for a legal entity, or for an individual entrepreneur. Therefore, we will characterize the documentation separately.

To obtain a signature, individuals must collect the following set of documentation:

  • Completed application form;
  • Passport with photocopy;
  • SNILS;
  • A receipt confirming the payment of the invoice.

If the recipient has a trusted person, they can take over the filing of documents. The only thing you need is a power of attorney to perform such actions.

Legal entities need to prepare:

  • Completed application;
  • Certificate of OGRN;
  • TIN certificate;
  • (not expired);
  • Passport with a copy of the person who will use the EDS;
  • Payment receipt;
  • SNILS of the person who will use the EDS;

Electronic signature for individuals

For individuals, there are 2 types of signatures: qualified and unqualified. The procedure for obtaining, when compared with legal entities, is much simpler.

Individuals usually use electronic signature to sign some papers.

Now for its application, such systems have been developed as:

For ESIA, a simple type of electronic signature is enough, but for the portal of public services, a qualified one is used.

To obtain an EDS, a citizen also applies to the CA, with all documents and an application. You also need to have a flash drive with you, on which the private part of the key, known only to the owner, will be recorded.

The procedure looks like this:

  • Apply to the CA for a certificate and to receive an EDS key;
  • Find a password;
  • Filling out forms for obtaining keys;
  • Submission of all documents;
  • Obtaining a certificate for keys.

Electronic signature for legal entities

The algorithm for obtaining is practically the same as for obtaining a signature by an individual. In the same way, the CA is selected, all the necessary documents are collected, the invoice is paid. The only thing to remember is that an extract from the Unified State Register of Legal Entities must be received on time, since the process of its preparation takes about 5 days.

Hash function: why is it needed

Hash function is a unique number that is obtained from the document by transforming it using an algorithm.

It is highly sensitive to various types of document distortions, if at least one character in the original document changes, most of the hash value characters are distorted.

The hash function is designed in such a way that it is impossible to recover the original document by its value, and it is also impossible to find 2 different electronic documents that have the same hash value.

To generate an EDS, the sender calculates the hash function of the document and encrypts it using a secret key.

Speaking in simple words, it is designed to facilitate the exchange of data between users. It is a key data protection tool.

The file to be signed goes through the hashing procedure. And the recipient will be able to verify the authenticity of the document.

Legal force of an EDS

EDS has equal legal force with the usual signature in the paper version of the document, if it was applied without violations. If deviations have been identified, the document has no effect. The state regulates the process of using EDS by Federal legislation.

EDS validity period

EDS is valid for 12 months from the day it was received. As soon as this period ends, it is extended or another one is received.

Legal force

A simple signature is equated to a handwritten signature if it is regulated by a separate regulatory act or an agreement has been concluded between the EDF participants, where it is spelled out:

  • the rules by which the signatory is determined by his simple electronic signature.
  • the user's obligation to maintain the confidentiality of the private part of the PEP key (for example, a password in a “login-password” pair or an SMS code sent to the phone).

In many information systems, the user must first confirm his identity during a visit to the system operator in order for his PEP to be legally valid in the future. For example, to receive a confirmed account on the State Services portal, you need to personally come to one of the registration centers with an identity document.

Unqualified electronic signature, or NEP

An enhanced unqualified electronic signature (hereinafter referred to as NEP) is created using encryption programs using the private key of an electronic signature. NEP identifies the identity of the owner, and also allows you to check whether changes have been made to the file after it was sent.

A person receives two electronic signature keys in the certification center: private and public. The private key is stored on a special key carrier with a pin code or on the user's computer - it is known only to the owner and must be kept secret. Using the private key, the owner generates electronic signatures with which he signs documents.

The public key of the electronic signature is available to everyone with whom its holder conducts EDF. It is associated with a private key and allows all recipients of the signed document to verify the authenticity of the electronic signature.

The fact that the public key belongs to the owner of the private key is recorded in the electronic signature certificate. The certificate is also issued by a certification authority. But when using NEP, the certificate does not need to be created. Requirements for the structure of an unqualified certificate are not established in Federal Law No. 63-FZ “On Electronic Signatures”.

Where is it used?

NEP can be used for internal and external EDI, if the parties have previously agreed on this.

Legal force

EDF participants must comply with additional conditions, to electronic documents, certified by the NEP, were considered equivalent to paper with a handwritten signature. The defendant explained the absence of payment by the fact that the submitted documents, certified in this way, are invalid, and therefore cannot serve as a basis for making settlements.

The court did not accept the explanations of the defendant, since earlier an additional agreement was signed between the former partners, allowing the use of documentation signed by the electronic signature within the framework of these contractual relations.

Electronic signature regulation is carried out within the framework of Federal Law No. 63 "On Electronic Signatures".

It regulates its use:

  • in civil transactions;
  • provision of public services;

2. What are the types of EDS - TOP-3 main types

Varieties of EDS are prescribed by law. Article 5 of FZ-63 mentions: simple and strengthened. Strengthened, in turn, is unskilled (UNEP) and qualified (UKEP).

Certification of such ES documents is legally required. Then they are legally binding and equal to written evidence on paper.

Today arbitration courts RF accepted for consideration the following documents certified by EDS:

  • statements;
  • petitions;
  • reviews.

Option 3. Document flow with individuals

Individuals still rarely sign any documents with a digital signature, although this practice is becoming more and more popular every year, especially among people working remotely.

Electronic digital signature allows them to exchange acceptance certificates for their services electronically. With the help of electronic signature, natural persons-inventors have the right to file a patent application on the Rospatent website. Its owners can write an application for state registration of an individual entrepreneur or legal entity directly on the website of the tax department.

Option 4. Public services

4. How to get an electronic signature - 6 easy steps

Step 3. Fill out and send an application

You can submit it in two ways:

  • fill out the form on the website of the center.

It contains only the most necessary information: full name, contact information (phone, e-mail).

After receiving the application, the CA manager will contact you and clarify all the data necessary for the issuance of an EDS, advise on prices and conditions.

Step 4. Pay the bill

After processing the application by the specialists of the center, you will receive an invoice for payment. As you know, services are usually paid according to the principle "Money in the evening, chairs in the morning", that is, on a 100% prepayment basis.

The cost of the ES is on average 5-7 thousand rubles, the minimum price is 1.5 thousand rubles.

It includes:

  • generating a signature key certificate;
