Vacation scheduling

The scheduling of vacations is provided for by Art. 123 of the Labor Code of the Russian Federation. This document determines the priority of providing employees with paid leave, and it is mandatory for both the employer and the employee. The vacation schedule ensures that employees are entitled to annual rest. Vacation scheduling allows an employer to:

  • arrange a vacation in advance and pay vacation pay;
  • find a replacement for an employee leaving on vacation;
  • monitor the timeliness of the provision of vacations to employees and prevent the accumulation of unused vacation days.

When scheduling vacations, it should be borne in mind that some employees have the right to use vacation at a convenient time for them. If the employee has a choice, it is advisable to get a statement from him when drawing up the schedule about what time he would like to go on vacation. If, when drawing up the vacation schedule, the wishes of the employee, indicated in his application, were taken into account, then the vacation time can subsequently be changed only by mutual agreement of the parties.

If the vacation schedule is approved, and the employee is not satisfied with the vacation time set there, he can ask to change the vacation dates. To do this, the employee must write an application for granting him vacation on dates different from those included in the vacation schedule. If the employer does not object to the postponement of the vacation, then the corresponding changes are made to the vacation schedule.

For the absence of a vacation schedule, the employer may be brought to administrative responsibility under paragraph 1 of Art. 5.27 of the Code of Administrative Offenses of the Russian Federation, which provides for a fine for the first violation:

  • for officials- from 1,000 to 5,000 rubles;
  • for individual entrepreneurs - from 1,000 to 5,000 rubles;
  • for legal entities- from 30,000 to 50,000 rubles.

With a repeated violation, the fines increase significantly, amounting to (clause 2 of article 5.27 of the Code of Administrative Offenses of the Russian Federation):

  • for officials - from 10,000 to 20,000 rubles. (it is also possible for them to be disqualified for a period of 1-3 years);
  • for individual entrepreneurs - from 10,000 to 20,000 rubles;
  • for legal entities - from 50,000 to 70,000 rubles.

The availability of a vacation schedule and its observance is checked by the labor inspectorate.

Whose opinion should be taken into account when scheduling

As a rule, when drawing up a vacation schedule, the opinion of each of the employees is taken into account. Moreover, it is better to collect information about who and when would like to go on vacation in writing in order to exclude later possible conflict situations.

At the same time, the employer is not obliged to unconditionally take into account all the wishes (with the exception of certain categories of employees). Here it is only important to combine the interests of personnel and business and to build such a sequence of vacations that will not interfere with the activities of the organization.

If the organization has a trade union, the vacation schedule is also coordinated with it (clause 1 of article 123 of the Labor Code of the Russian Federation).

What to reflect in the vacation schedule

The vacation schedule includes:

  • annual basic paid leave;
  • additional vacations;
  • information about the transfer of vacations.

Holidays without saving wages are not indicated in the vacation schedule.

Vacation Schedule: Registration Rules and Changes

Vacation schedule - the rules for registration and amendments to it are regulated both by the Labor Code of the Russian Federation and by the decree of the State Statistics Committee of the Russian Federation dated 05.01.2004 No. 1 "On approval of unified forms of primary accounting records on labor accounting and remuneration "(in terms of filling out the schedule in a unified form).

The employer must approve the vacation schedule no later than 2 weeks before calendar year, i.e. no later than December 17th. If the deadline falls on a weekend, then it is shifted to the next closest working date. The lawfulness of such a transfer was confirmed by the Ministry of Labor (by letter dated 08.12.2017 No. 14-2 / ​​OOG-9399). In 2018, this date fell on a working day - Monday.

How to make a vacation schedule

The vacation schedule of the T-7 form is drawn up as follows:

  • column 1 indicates the name of the structural unit;
  • column 2 reflects the position (specialty, profession) of the employee according to the staffing table;
  • in columns 1 and 2, information is indicated in accordance with the staffing table;
  • in column 3, the full name of the employee is indicated;
  • in column 4, a personnel number is put down (this column is filled out if the organization assigns personnel numbers to employees);
  • column 5 indicates the number of calendar days due to the employee vacation;
  • column 6 indicates the planned vacation date.

At the time of approval of the vacation schedule, columns 1-6 of the T-7 form must be completed.

Changes to the vacation schedule are made when the vacation is postponed with the consent of the employee and in case of recall from vacation (Article 124, Part 2, Article 125 of the Labor Code of the Russian Federation, Resolution of the State Statistics Committee of the Russian Federation dated 05.01.2004 No. 1). In these cases, corrective information is entered in columns 8 and 9:

  • column 8 indicates the document on the basis of which the vacation is transferred;
  • in column 9 the date of the beginning of the use of the vacation (or part of it) is given;
  • in column 10 you can specify additional information(for example, the reason for the transfer of vacation, recall from vacation, and other information).

Column 7 shows the dates of the actual departure of the employee on vacation.

In case of replacement of part of the vacation monetary compensation this information should be reflected in the vacation schedule. To do this, in column 10 "Note" of the vacation schedule, you must make an entry that part annual leave(indicate the number of days) was replaced with monetary compensation and reflect the details of the order to replace the vacation with monetary compensation.

Another point regarding the amendment of the vacation schedule is related to the vacations of part-time workers. The planned vacation of such an employee is reflected in the vacation schedule for the main place of work and part-time. At the same time, if a part-time employee is postponing leave at the main place of work, then such a transfer should be reflected not only in the vacation schedule at the main place of work, but also in the part-time vacation schedule. This is due to the fact that according to Art. 286 of the Labor Code of the Russian Federation, annual paid leave for a part-time worker is provided simultaneously with annual paid leave at his main place of work.

The vacation schedule is approved at the end of the previous year, and new employees are hired throughout the year. The question arises: is it necessary in this case to make changes to the vacation schedule? Making changes to the vacation schedule for re hired workers regulatory documents not settled. In practice, one of 2 options is used:

  1. An application is drawn up to the current vacation schedule in the form of T-7, which reflects information on the vacations of new employees. Moreover, if the organization has a trade union, then the vacation schedule for new employees is previously agreed with it (part 1 of article 123, article 372 of the Tax Code of the Russian Federation).
  2. The vacation schedule approved before hiring a new employee is not adjusted. The departure of a new employee on vacation is carried out in agreement with the head.

When scheduling vacations, it is better to have a sample of filling in front of your eyes.

However, it is still advisable to acquaint the staff with this document. To do this, you can draw up a separate sheet, where each employee signs, or supplement the unified form T-7 - a vacation schedule with lines in which signatures about acquaintance will be put.

Often the question arises: does the employee need to write an application for a vacation provided for by the vacation schedule? For the answer, let us turn to Part 3 of Art. 123 of the Labor Code of the Russian Federation, according to which the employee must be notified on receipt of the start time of the vacation no later than 2 weeks before the start. It follows from this that in order for an employee to go on vacation in accordance with the vacation schedule, it is required to notify the employee, not the employer. An additional statement from the employee is not required.

Keeping a vacation schedule

Vacation schedule - the T-7 form must be kept in the organization for 1 year after its expiration (clause 1.4 of article 693 of the order of the Ministry of Culture of Russia dated 25.08.2010 No. 558). For example, the 2019 vacation schedule, approved in December 2018, expires on 12/31/2019, therefore, you need to keep the 2019 vacation schedule throughout 2020.

The expired vacation schedule and other similar documents are destroyed in accordance with the acts on the destruction of documents (clauses 2.2.5, 2.3.2, 2.4.5 of the Basic Rules for the Archives of Organizations, approved by the decision of the Rosarchiv Board dated 06.02.2002).

Who approves the vacation schedule

First of all, in the presence of a primary trade union cell, coordination with it is required. The trade union assesses, first of all, whether the rights of employees, for whom rest is provided on those dates when it is convenient for them, have been taken into account (minors, single parents with 2 or more children, etc.). After receiving approval, the details of the letter or other document justifying this are entered in the header of the document. Does the employee need to write a vacation application if there is a schedule

Penalty for not having a vacation schedule

Since the schedule is a mandatory document in the company (Article 123 of the Labor Code of the Russian Federation), for its absence there are penalties established by Art. 5.27 of the Administrative Code of the Russian Federation.

The gradation of the amount of punishment depends, first of all, on the perpetrator. The maximum punishment is provided for legal entities: from 30 to 50 thousand rubles or suspension of activities for up to 90 days. For officials and individual entrepreneurs, the fine is from one to five thousand. Suspension of activities (up to 90 days) is also provided for individual entrepreneurs.

What information should be reflected in the schedule?

The vacation schedule is a consolidated document, it is drawn up in one copy and is valid for one calendar year, therefore, in practice, it is assigned number 1.

If the employee came to work in the first half of the year and is not going on vacation in the current year, then there is no need to make changes to the vacation schedule. The right to the first vacation arises only after six months of work (part 2 of article 122 Labor Code RF).

Pay attention to how the following details are filled in:

Name of company- is indicated in full accordance with the constituent documents. If there is an abbreviated name, the full name is indicated, and then the abbreviated one in brackets.

Organization code- is affixed in the coding area as a number of eight characters per All-Russian classifier enterprises and organizations (OKPO)

You can fill in the schedule both in alphabetical order and in the order of the planned vacation dates. But in the latter case, the names of employees who decided to divide the vacation into parts will be repeated.

How long should the vacation be on the schedule?

Before filling in column 5 for all employees, determine how many vacation days employees are entitled to apply for next year.

Minimum vacation time... The duration of the annual paid vacation is 28 calendar days (part 1 of article 115 of the Labor Code of the Russian Federation).

Extended leave... For some categories of employees, extended annual paid vacations are established (part 2 of article 115 of the Labor Code of the Russian Federation):

Vacation can be divided into parts by mutual agreement between the employee and the employer.

Do not forget to include in the schedule the vacation days not used in previous years.

Add unused vacation days from previous years to the vacation that is scheduled for the upcoming calendar year. For example, an employee is entitled to leave for 28 calendar days. Features of drawing up and filling

What types of vacations are scheduled?

If the current position of the organization requires the employee to rest in a different time period of the current year, then the employer has the right to postpone the vacation.

However, this should only happen if the employee does not mind. All this is reflected in the form: in columns 8 and 9, the number of the transfer order and the new release date are entered.

Is it necessary to include in the schedule employees on parental leave, incl. working part-time?

If the employee is in maternity leave, then it does not need to be included in the vacation schedule. However, if a young mother combines raising and caring for a child with part-time work, then she, like other employees, has the right to go on annual paid leave.

At the same time, the duration of the leave and the procedure for granting it, as well as the sample of filling out the schedule, do not differ from the conditions for granting annual leave to the rest of the staff.

The only difference is that she will receive less vacation pay, since this parameter depends on her salary, which for an incomplete work time proportionally less than full-time employment.

Do I need to make changes if an employee decides to take a vacation at a different time?

If an employee of the organization, for any personal reason, wants to go on vacation at a different time, then he must write a statement about his desire.

It is written in free form, since such a form is not provided.

If the management of the organization agrees with this procedure, then the corresponding changes are made to the vacation schedule in columns 8 and 9.

They should include the details of the order on the basis of which the vacation is moved, the date of the order, the new date of the employee's leave on vacation.

Do I need to add new employees?

Those employees who have been working at the enterprise for less than a year are not included in the vacation schedule, especially if hired after the schedule has been approved.

The right to go to appears only for a beginner.

How to plan and capture a part-time vacation?

Do I need to include unused vacations in the past?

How to familiarize an employee?

The administration of the enterprise is obliged to provide the employee with the vacation schedule for review no later than two weeks before the start date.

In this case, the signature of the employee is required, with which he confirms his agreement with this document. To do this, the employer can draw up a separate familiarization sheet (made in any form, usually in a tabular form), where each employee signs that he has familiarized himself with the schedule and does not object to such a layout.

In this case, an order must be issued within the enterprise legalizing the change in the unified form T7.

There are no strict rules regarding notifying an employee of the start date of his vacation.

By law, every employee must go on vacation at least once during the year. To streamline this process, the company must have a vacation schedule. For these purposes, personnel officers usually use a vacation schedule in the form of t-7, which is drawn up and put into effect 2 weeks before the end of the current calendar year.

Let's take a closer look at how to make a vacation schedule.

If the company has a union body, then information about the written opinion expressed by it must be indicated in the columns on the left side of the form.

This document must be accepted by the head of the company or the entrepreneur. Therefore, on the right side, he needs to put his signature, its decoding, indicates the position held. It also records the date when the schedule was approved.

The main part of the document looks like a large table in which vacation information is entered line by line. It must be filled in in such a way that first the name of the department is indicated, and after that the employees working there are listed.

Column 1 records the designation of the unit. Column 2 indicates the title of the position in the same form as it is entered in staffing table.

In the next columns 3 and 4, the full name is entered. the employee and the number assigned to him.

Column 5 lists the total number of rest days an employee can qualify for.

Column 6 is the date on which he wants to go on vacation. In this case, in column 7, you need to indicate the date on which the vacation was actually granted.

If the vacation was postponed to a different time, then in column 8 you need to enter information about the order by which this was done, and in column 9 put down the new agreed date for the start of the vacation.

Column 10 is designed to make notes about the transfer of vacation, the recall of an employee from it and other similar information.

The executed document must be signed by the head of the HR department.

Approval procedure

The vacation schedule is approved according to the following scheme:

  • If the company has a trade union body, then the schedule must be previously agreed with it. To do this, the draft document is sent there along with cover letter;
  • The trade union must consider the received draft vacation schedule, and within five days express its reasoned opinion in writing;
  • Opinion can be either positive or negative. In the latter case, negotiations are held between the management of the company and the trade union until the issue is resolved;
  • The schedule must be accepted no later than 2 weeks before the onset of the calendar year (before December 17);
  • Schedule approval can be done in two ways:
    • The corresponding inscription is affixed directly on the chart form;
    • A separate one is being issued. This method is more convenient, since it is possible to appoint responsible persons at the disposal, determine the sources of payment for vacations, designate a method for informing employees about the upcoming vacation, etc. The order must also be issued no later than 2 weeks before the end of the year.

When are changes made

Current legislation does not prohibit making changes to the previously adopted vacation schedule. However, such events are a necessity, especially if new employees are hired in the company, or the employees have a need to move their rest period to another time.

The TC indicates the case when the company is unconditionally obligated to postpone the vacation for a different time:

  • While on vacation, the employee fell ill;
  • During the vacation, the employee has a need to exercise his civil rights, and during this time the law provides for exemption from work.

Important! You also need to move the vacation period to a new one, if the person in charge did not warn the employee 2 weeks in advance about the approaching vacation time. In order to make such a change, the employee must fill out an application stating new vacation dates.

The law establishes cases when the administration has the right to postpone vacation, if the absence of an employee in his place may violate normal work firms. However, in this case, it is imperative to obtain the written consent of the employee himself for this action.

Procedure for making changes

There are two reasons why it is necessary to make changes in the vacation schedule.

If this needs to be done at the request of the employee himself:

  • The employee draws up an application in which he indicates the reason for the transfer and the new desired dates of rest;
  • The manager reviews the document, and at his will approves it or not;
  • If the director has approved the transfer, then the application is forwarded to personnel department where they make out;
  • In the available vacation schedule in the "Note" field, the details of the application are indicated.

If the transfer of vacation is necessary due to production needs, the procedure changes somewhat, since the consent of the employee must be obtained:

  • Negotiating with the employee about the transfer of vacation time;
  • If the employee agrees, then he writes consent to the transfer, or signs a ready-made form;
  • Consent is transferred to personnel service, where, on its basis, an order is drawn up to change the vacation schedule;
  • In the existing schedule, the details of consent are recorded in the "Note" field.
